Penalties for Circulating LPG Cylinders Not Complying with Technical Standards?

Based on Point b Clause 2 Article 41 of Decree 99/2020/ND-CP, the regulations are as follows:

"2. Fines ranging from 20,000,000 VND to 40,000,000 VND shall be imposed for one of the following violations related to the conditions of LPG cylinders (including mini LPG cylinders) circulating in the market:

…

b) Circulating LPG cylinders in the market that do not meet technical standards or LPG cylinders that have not undergone safety technical inspections as required."

In addition, according to Article 5 of this Decree, it is stipulated: The fines specified in Chapters II, III, and IV of this Decree are applicable to organizations. In cases where administrative violations are committed by individuals, the fine shall be half of the fine stipulated for organizations.

Since this Article 41 falls under Chapter IV, the fines mentioned above are applicable to organizations.

Therefore, according to the above regulations, any organization circulating LPG cylinders in the market that do not meet technical standards will be fined from 20,000,000 VND to 40,000,000 VND. In addition, they shall be required to recall LPG cylinders that do not meet the conditions for circulation in the market (Clause 3 of this Article).
