My wife and I bought a piece of land in the countryside, planning to build a house, the ward official said that because it is in the overhead conducting line, when building a house, we must ensure the conditions prescribed by law to ensure safety for people who often live in the house. And I have a question that when building a house in the area of ​​​​corridor of the 220kV overhead conducting line, how many meters away must the parts of the house be?

When building a house, how many meters away from corridor of the 220kV power line in Vietnam?

In Article 13 of Decree 14/2014/ND-CP as amended by Clause 9, Article 1 of Decree 51/2020/ND-CP stipulating requirements for houses and workplaces to remain inside buffer zones of overhead high-voltage transmission lines with a voltage of up to 220 kV, as follows:

Houses and constructional works are permitted to exist within the safety corridor of overhead conducting line with voltage up to 220 kV if meeting the following conditions:

1. Roof and wall must be made of non-combustible materials.

2. No obstruction of way in and out for testing, maintenance and replacement of parts of high-voltage grid.

3. The distance from any part of houses or works to the nearest conducting line when the line is at the state of maximum deflection is not less than the distance specified in the following table:

4. The electric field intensity is less than 5 kV/m at any point outside the house and one meter (01) from the ground and less than or equal to 1 kV/m at any point inside the house and one meter (01) from the ground.

5. For houses and works within the safety corridor of overhead conducting line with voltage of 220 kV, besides meeting the above conditions, the metal structures of houses and works must be connected to earth under regulations on earthing techniques.

6. The Ministry of Industry and Trade stipulates in detail the scope and earthing techniques of metal structure of houses and works within and adjacent to the safety corridor of overhead conducting line with voltage from 220 kv and above.

According to this Article, when you want to build a house in the area of ​​the corridor of overhead conducting line with voltage up to 220 kV, the distance from any part of the house you build to the nearest electrical conductor when the wire is in a state of maximum deflection not less than 6.0 meters in Vietnam.

How much is fine for an individual who builds a house in safety corridor of overhead conducting line without a safety agreement in Vietnam?

According to Clause 18, Article 2 of Decree 17/2022/ND-CP amending Clause 3, Clause 8, Clause 9 Article 15 of Decree 134/2013/ND-CP providing for handling of violation of regulations on electrical safety, according to which :

3. A fine ranging from VND 10.000.000 to VND 20.000.000 shall be imposed on:

a) Using any components of electrical grid for other purposes without agreeing with entities managing operation of electrical grid;

b) Unloading, piling, or arranging materials, components, and equipment beneath overhead power lines and failing to ensure minimum approach distance by voltage from power lines to materials, components, and equipment;

c) Using any parts of houses, structures which are allowed to be located within safety perimeter of overhead power lines for other purposes in a manner that violates minimum approach distance by voltage;

d) Building or renovating houses, structures situated within safety perimeter of overhead power lines without reaching an agreement or complying with existing agreements with entities managing operation of the power lines in order to ensure safety in construction and renovation of houses, structures;

dd) Loading commodities, materials, components, planting trees, or anchoring watercrafts within the safety perimeter of underground power cables;

e) Building houses or structures in a manner that interferes with entrances or vents of electrical substations, power plants;

g) Failing to adequately adopt construction measures when working with work items and equipment along power system, except for violations under Point dd Clause 2 of this Article;

h) Failing to produce list of electrical equipment and instruments that require inspection for monitor and management in accordance with regulations on safety technical inspection of electrical equipment and instruments;

i) Stealing electricity of a customer for another household;

k) Stealing electricity of a customer for purposes other than those under signed contracts without permission;

l) Repairing, replacing, maintaining, or otherwise altering circuits approved under electricity trading agreements before completing training courses regarding electrical engineering, civil electricity, and electrical safety;

m) Starting a fire, combusting, or committing slash-and-burn in a manner that poses risk to operation safety of electrical grid.

8. Additional penalties:

Confiscation of exhibits and instruments of administrative violations for violations under Clause 3; Point a, Point c, and Point d Clause 4; Points a, b, c, d, and dd Clause 5; Point c Clause 6; Point a and Point c Clause 7 of this Article.

9. Remedial measures:

a) Mandated restoration to original state for violations under Point b and Point c Clause 2; Clause 3; Point c and Point d Clause 4; Point a, Point c, Point d, and Point i Clause 5; Point c Clause 6 and Clause 7 of this Article;

b) Mandated submission of illegal revenues generated by inspection activities to state budget for violations under Point dd and Point e Clause 6 of this Article.

Thus, individuals who build houses in the safety corridor of overhead conducting line without having an agreement on safety assurance with the line operation management unit will be fined from VND 10,000,000 to VND 10,000,000. 20,000,000 VND in Vietnam.

In addition, material evidences and means of administrative violations will be confiscated for violations and forced to restore to their original state with violations in Vietnam.

What are regulations on safety corridor of power station in Vietnam? 

Pursuant to Article 15 of Decree 14/2014/ND-CP stipulating safety corridor of power station, as follows:

1. The safety corridor of power station is specified as follows:

a) For power stations without wall or fence, the safety corridor is limited by the space around the power station with the distance to the nearest charged objects of the station as specified in the following table:

b) For the power station with fixed wall or fence, the safety corridor is limited to the outmost point of foundation or protection embankment of wall or fence; the height of corridor is from the deepest foundation bottom of the power station to the highest point of the power station plus the vertical safety distance specified at Point c, Clause 1, Article 11 of this Decree;

c) For integrated substations or power distribution stations with metal case, the safety corridor is limited to the outer side of metal case.

2. Houses and constructional works near the safety corridor of power station must ensure no damage to any part of power station; no obstruction to the way in and out, the water supply and drainage system, the safety corridor of underground cable and overhead conduction line, the ventilation system of the power system and no wastewater intrusion causing damage to the electrical works.

With this regulation, the safety corridor of power station in Vietnam is prescribed as above.
