What are the Responsibilities of the District People's Committee in State Management of Environmental Protection?
According to Clause 2, Article 168 of the Law on Environmental Protection 2020 (Effective from January 1, 2022) stipulating the responsibilities of state management on environmental protection of the People's Committee at various levels, including:
The district-level People's Committee, within the scope of its duties and powers, has the following responsibilities:
- To develop, promulgate or submit to the competent authorities for promulgation legal normative documents on environmental protection, plans, programs, schemes, and projects on environmental protection of the locality;
- To issue, renew, adjust, re-issue, revoke environmental permits according to its competence;
- To direct, guide, inspect and organize the implementation of pollution source control; to prevent and respond to environmental incidents in the local area in accordance with the law; to organize the management of emission sources in the local area according to assignments and decentralization; to be responsible to the provincial-level People's Committee for environmental pollution occurring within the local area;
- To organize the monitoring, supervision, warning, environmental quality management, and waste management in the local area according to its competence or as decentralized by the provincial-level People's Committee; to renovate and restore the environment; to conserve nature and biodiversity;
- To inspect, inspect and handle violations of environmental protection laws according to its competence or transfer the competent authorities for handling according to regulations of the law; to resolve complaints, denunciations, and petitions about environmental protection;
- To communicate, disseminate knowledge, and propagate laws on environmental protection; to educate and raise awareness, and consciousness about environmental protection within the community;
- To provide information about the environment and environmental reports according to regulations of the law;
- To mobilize and utilize resources for environmental protection in accordance with the law; to submit to the People's Council at the same level or the competent authorities for arranging funds to perform environmental protection tasks according to the current budget decentralization;
- To perform other environmental protection tasks assigned by the provincial-level People's Committee.
