What are the fines for throwing cigarette butts, leftovers and ashes at public areas in Vietnam?
Pursuant to Clause 2 Article 25 of the Decree 45/2022/NĐ-CP stipulating offences against regulations on environmental protection in public areas, urban areas and residential areas; transport of raw materials, materials and goods causing environmental pollution as follows:
2. Penalties for collecting or discharging waste in contravention of regulations on environmental protection are as follows:
a) A fine ranging from VND 100,000 to VND 150,000 shall be imposed for throwing, littering or discarding cigarette butts, leftovers and ashes at undesignated locations in apartment buildings, commercial, service or public areas;
b) A fine ranging from VND 150,000 to VND 250,000 shall be imposed for addressing personal sanitation needs (e.g. urination, defecation) at undesignated locations in apartment buildings, commercial, service or public areas;
c) A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for throwing or littering waste or pouring wastewater at undesignated locations in apartment buildings, commercial, service or public areas, except for the offence mentioned in point d of this clause;
d) A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed for throwing or littering domestic waste on sidewalks, pavements or municipal sewerage systems or surface water drainage systems; for pouring wastewater at undesignated locations on road sidewalks or pavements; discharging domestic plastic waste into ponds, lakes, channels, rivers, streams or sea.
Pursuant to Clause 2 Article 6 of the Decree 45/2022/NĐ-CP stipulating as follows:
2. Fines for administrative offences prescribed in Chapter II herein are the ones for the administrative offences committed by individuals. The fine incurred by an organization is twice as much as that incurred by an individual for the same offence.
As regulations above, a fine ranging from VND 100,000 to VND 150,000 shall be imposed for throwing, littering or discarding cigarette butts, leftovers and ashes at undesignated locations in apartment buildings, commercial, service or public areas in Vietnam.
What are the fines for throwing cigarette butts, leftovers and ashes and that causes a fire or explosion and property damage of more than 100.000.000 VND in Vietnam?
Pursuant to Article 51 of the Decree 144/2021/NĐ-CP stipulating penalties for causing fire or explosion as follows:
1. A fine ranging from 100.000 VND to 300.000 VND shall be imposed for any violation against regulations on fire prevention and firefighting that causes a fire or explosion and property damage of less than 20.000.000 VND.
2. A fine ranging from 1.000.000 VND to 3.000.000 VND shall be imposed for violations against regulations on fire prevention and firefighting that causes a fire or explosion and property damage of from 20.000.000 VND to less than 50.000.000 VND.
3. A fine ranging from 3.000.000 VND to 5.000.000 VND shall be imposed for violations against regulations on fire prevention and firefighting that causes a fire or explosion and property damage of from 50.000.000 VND to less than 100.000.000 VND.
4. A fine ranging from 5.000.000 VND to 10.000.000 VND shall be imposed for any of the following violations:
a) Any violation against regulations on fire prevention and firefighting that causes a fire or explosion and property damage of more than 100.000.000 VND;
b) Any violation against regulations on fire prevention and firefighting that cause bodily harm upon 01 person with whole person impairment (WPI) of less than 61%;
c) Any violation against regulations on fire prevention and firefighting that cause bodily harm upon 02 or more persons, each of whom suffers < 61% WPI.
5. Remedial measure:
Mandatory payment of the entire medical examination and treatment cost in case of violations specified in Point b and Point c Clause 4 of this Article.

What are the fines for smoking in hospitals in Vietnam?
Pursuant to Article 11 of the Law on Tobacco Harm Prevention in 2012 stipulating places where smoking is completely prohibited as follows:
1. Places where smoking is completely prohibited indoors or outdoors, include:
a/ Medical establishments;
b/ Educational institutions, except for those specified in Point b Clause 2 of this Article;
c/ Childcare facilities and recreation facilities for children;
d/ Facilities or areas with high risk of fire and explosion.
2. Places where smoking is completely prohibited indoors include:
a/ Workplaces;
b/ Colleges, universities and academies;
c/ Public places, except for the cases specified in Clause 1 of this Article and Clause 1, Article 12 of this Law.
3. Means of public transportation where smoking is completely prohibited are automobiles, airplanes and trams.
Pursuant to Article 25 of the Decree 117/2020/NĐ-CP stipulating violations against regulations on non-smoking areas as follows:
1. A warning or a fine ranging from VND 200.000 to VND 500.000 shall be imposed for smoking in non-smoking areas. Acts of in-light smoking shall be penalized in accordance with regulations on penalties for administrative violations in civil aviation sector.
2. A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for commission of one of the following violations:
a) Failing to display “non-smoking” words or signs at non-smoking areas as prescribed by law;
b) Failing to organize, instruct, inspect and expedite the implementation of smoking bans in areas under management.
3. A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for commission of one of the following violations in designated smoking areas:
a) Failing to provide rooms and air ventilation systems separate from non-smoking areas;
b) Failing to provide containers of tobacco butts and ashes;
c) Failing to display signs at suitable and prominent positions;
d) Failing to provide firefighting equipment.
Pursuant to Clause 5 Article 4 of the Decree 117/2020/NĐ-CP stipulating as follows:
5. The fines prescribed in Chapter II hereof are imposed on violating individuals. The fine imposed on an organization is twice as much as that imposed on an individual for the same administrative violation.
As regulations above, a warning or a fine ranging from VND 200.000 to VND 500.000 shall be imposed for smoking in hospitals in Vietnam.
