What are the fines for parking in front of fire extinguisher stands in Vietnam? What are fire prevention and fighting equipment in Vietnam? Which entities shall have responsibilities for fire prevention and fighting in Vietnam?

Hello Lawnet. Recently, some people park their car in front of fire extinguisher stands in the parking lot at my apartment even when there are "No Parking" signs. What are the fines for those acts?

What are the fines for parking in front of fire extinguisher stands in Vietnam?

Pursuant to Article 44 of the Decree 144/2021/NĐ-CP stipulating violations against regulations on provision, storage and use of fire safety and firefighting equipment in Vietnam as follows:

1. A warning or a fine ranging from 100.000 VND to 300.000 VND shall be imposed for any of the following violations:

a) Visually or physically blocking the access of fire safety and firefighting equipment;

b) Use of unfit common firefighting equipment as prescribed by law;

c) Failure to prepare documents for management of fire safety, firefighting and rescue equipment.

2. A fine ranging from 500.000 VND to 1.500.000 VND shall be imposed for any of the following violations:

a) Failure to periodically inspect and maintain the fire safety and firefighting equipment and system;

b) Failure to preserve personal protective equipment and extinguishing agent as prescribed by law;

c) Failure to have adequate or compatible fire safety and firefighting equipment as prescribed by law;

d) Failure to provide common firefighting equipment on motor vehicles as prescribed by law;

dd) Losing, damaging or compromising common firefighting equipment, extinguishing agents, firefighting communication devices.

3. A fine ranging from 3.000.000 VND to 5.000.000 VND shall be imposed for any of the following violations:

a) Providing, installing, using fire safety and firefighting equipment that have not undergone fire prevention and firefighting inspection as prescribed by law;

b) Providing fire safety and firefighting equipment that is not suitable for the fire hazards/explosion hazards of the facility as prescribed by law;

c) Use of firefighting equipment at its post for unintended purposes;

d) Use of the firefighting water source for unintended purposes or failure to have adequate reserve of water for firefighting as prescribed by law;

dd) Moving, relocating fire safety and firefighting equipment against the designed approved by a competent authority;

e) Failure to provide common firefighting equipment on motor vehicles that transport goods with fire hazards/explosion hazards as prescribed by law.

4. A fine ranging from 5.000.000 VND to 10.000.000 VND shall be imposed for any of the following violations:

a) Failure to provide common firefighting equipment in houses, buildings or on motor vehicles that have special fire safety requirements for passenger transport as prescribed by law;

b) Losing, damaging or compromising firefighting apparatus, fire alarm or firefighting system;

c) Failure to maintain the readiness of the available firefighting apparatus, fire alarm or firefighting system as prescribed by law;

d) Falsifying the certificate of inspection of fire safety and firefighting equipment.

5. A fine ranging from 15.000.000 VND to 25.000.000 VND shall be imposed for any of the following violations:

a) Failure to install the fire alarm and firefighting system as prescribed by law;

b) Failure to have firefighting apparatus as prescribed by law.

6. Remedial measures:

a) Mandatory restoration of original condition in case of violations specified in Point b Clause 4 of this Article;

b) Mandatory return of the certificate of inspection of fire safety and firefighting equipment in case of violations specified in Point d Clause 4 of this Article.

As regulations above, the act of visually or physically blocking the access of fire safety and firefighting equipment shall be fined from 100.000 VND to 300.000 VND.

What are fire prevention and fighting equipment in Vietnam?

Pursuant to Appendix VI of the Decree 136/2020/NĐ-CP stipulating the List of fire prevention and fighting equipment in Vietnam as follows:

1. Motor firefighting equipment

a) Fire trucks: fire trucks with tanks, fire trucks without tanks, airport fire trucks, forest fire trucks, chemical (powder, foaming agent, gas) fire trucks, tunnel fire trucks, railway fire trucks and amphibious fire trucks;

b) Firefighting vehicles: ladder trucks; bucket trucks; command vehicles; command center vehicles; fire scene examination vehicles; lighting vehicles; pumpers; water tenders; equipment carriers; firefighter carriers; chemical carriers; rescue vehicles; smoke removal vehicles; technical maintenance vehicles; logistics vehicles; crane trucks; chemical, biological and nuclear hazard handling vehicles; extinguishant carriers; breathing apparatus transport and charging vehicles; fire hose carriers; fuel carriers; ambulances; and fire bikes;

c) Firefighting aircrafts; firefighting boats; firefighting canoes; firefighting motorboats; other firefighting floating structures with motor;

d) Firefighting pumps;

dd) Other motor equipment: air charging machines; sawing, cutting, drilling, hammering, winching, pulling and spreading equipment (with motor), power inverters, bucket equipment, vegetation processing equipment (vegetation cutters, grass cutters); PPV fans; smoke extract fans; power generators; air blowers; and shoulder-supported fire extinguishers with motor.

2. Common firefighting equipment

a) Fire hoses and suction hoses;

b) Hose nuzzles;

c) Dividing breechings, ejectors;

d) Fire hydrants;

dd) Fire ladders;

e) Powder, foam, gas and water-based fire extinguishers.

3. Extinguishants: water-based firefighting chemicals, firefighting powder, firefighting gas and firefighting foaming agents.

4. Fire-resistant substances or materials; fire protection materials, fire protection doors, fire protection glass, fire protection dividers, fire dampers; and fire curtains.

5. Equipment of fire alarm systems: fire alarm control panels, detectors of all types, early warning equipment, modules of all types, fire alarm bells, fire alarm lights, fire alarm pull stations, fire alarm buttons, fire alarm sound systems and evacuation instructions.

6. Equipment of firefighting systems (by gas, aerosol, water, powder, foam): firefighting control panels; extinguishant releasing bells, horns, lights and signs; alarm valves, deluge valves, supervisory valves, selector valves, pressure switches, flow switches; non-metal pipes in automated firefighting water supply systems, soft pipes used for fire hoses; hose connections of fire hydrants, extinguishant hoses of all types; bottles and equipment containing firefighting gas, aerosol, powder and foam of all types.

7. Escape lights, emergency lights.

8. Personal protective clothing and equipment

a) Firefighting trousers, tops, hats, boots, gloves, shoes, belts, glasses and face masks; heat-resistant trousers, tops, hats, boots, gloves and shoes; insulated boots and gloves; personal lighting equipment;

b) Toxic-filtering respirators; respiratory protective devices; self-contained breathing apparatus.

9. Human rescue equipment: human rescue ropes; rescue belts; human rescue mattresses; human rescue ladders; evacuation slides; human detectors; high-altitude rescue equipment; underwater rescue equipment; confined space rescue equipment; equipment for rescue during events of chemical and radiation hazards; first-aid equipment.

10. Forcible entry tools: pliers, saws, hammers, axes, hoes, shovel, crowbars, multi-purpose forcible entry tools, long-handled sickles, machete, rakes, flappers.

11. Equipment for communication, commanding of firefighting operations and rescue

a) Command tables, command tents, command flags, incident commander armbands;

b) Wired communication systems;

c) Radio communication systems, surveillance equipment supporting commanding of forest and aerial firefighting operations, handheld GPS devices.

12. Equipment for inspection of fire safety and fire prevention and fighting equipment./.

Above are the List of fire prevention and fighting equipment in Vietnam.

Which entities shall have responsibilities for fire prevention and fighting in Vietnam?

Pursuant to Article 5 of the Law on Fire Prevention and Fighting in 2001 (amended by Clause 2 Article 1 of the Law on Amendments to Law on Fire Prevention and Fighting in 2013) stipulating as follows:

1. To prevent and fight fire is the responsibility of every agency, organization, household or individual on the territory of the Socialist Republic of Vietnam.

2. Citizens, who are full 18 years of age or older and have good health shall have to join civil defense groups or grassroots fire brigades set up at their residential or working places, when so requested.

3. Heads of agencies or organizations within their duties and power shall:

a) Propagate and disseminate knowledge about the fire prevention and fighting; develop the all-people movement participating in fire prevention and fighting; form and maintain the activities of team of fire prevention and fighting as prescribed by law;

b) Promulgate under the authority the rule and measures on fire prevention and fighting;

c) Implement, inspect and supervise the compliance with regulations on fire prevention and fighting;

d) Ensure funding for the activities of fire prevention and fighting and properly use it; equipping and maintaining the activities of tools and means of fire prevention and fighting, preparing the conditions for fire fighting; formulate and practice fire fighting plan, ensure the conditions for professional training of fire prevention and fighting and organize the fire fighting and make good the consequences caused by fire;

dd) Perform other duties on fire prevention and fighting as prescribed by law;

3a. Family holders shall:

a) Urge and remind family members to comply with regulations on fire prevention and fighting;

b) Regularly inspect, detect and promptly remedy the risk of fire or explosion;

c) Coordinate with other organizations, agencies and family households in ensuring the conditions for fire prevention and fighting; strictly control and safely use flammable or explosive substances;

3b. The individuals shall:

a) Comply with regulations, rules and requirements on fire prevention and fighting of the competent persons or authority;

b) Comply with the law and thoroughly grasp necessary knowledge about fire prevention and fighting; know how to use common tools and means of fire prevention and fighting;

c) Ensure the safety of fire prevention and fighting during the use of source of fire or heat, the fire or heat generating equipment and tools and in preservation and use of inflammable materials;

d) Prevent the risk of direct fire generation and acts of violation of regulations on safety of fire prevention and fighting;

dd) Comply with other regulations related to personal responsibility in this Law.

4. The fire fighting police shall have to guide and inspect fire prevention and fighting activities of agencies, organizations, households and individuals and perform fire-fighting task.
