Decree 9/2025/ND-CP on the policy to support agricultural production to restore production in areas damaged by natural disasters and plant pests in Vietnam

On January 10, 2025, the Government of Vietnam issued Decree 9/2025/ND-CP regulating policies on supporting crops, livestock, aquaculture, forestry, salt production, or a part of the initial production cost to restore agricultural production in areas damaged by natural disasters and plant pests.

Decree 9/2025/ND-CP applies to Vietnamese agencies, organizations, and individuals; foreign organizations and individuals, involved or participating in supporting agricultural production to restore production in areas damaged by natural disasters and plant pests in Vietnam.

Decree 9/2025/ND-CP is effective from February 25, 2025.

What are support levels for damage from natural disasters, plant pests in Vietnam from February 25, 2025?

Based on Article 5 of Decree 9/2025/ND-CP, the support levels for damage caused by natural disasters and plant pests are specified as follows:

[1] Support levels for crop damage caused by natural disasters and plant pests:

- Rice area:

+ After sowing from 01 to 10 days: damage over 70% area, support 6,000,000 VND/ha; damage from 30% to 70% area, support 3,000,000 VND/ha.

+ After sowing from over 10 days to 45 days: damage over 70% area, support 8,000,000 VND/ha; damage from 30% to 70% area, support 4,000,000 VND/ha.

+ After sowing over 45 days: damage over 70% area, support 10,000,000 VND/ha; damage from 30% to 70% area, support 5,000,000 VND/ha.

- Nursery area: Damage over 70% area, support 30,000,000 VND/ha; damage from 30% to 70% area, support 15,000,000 VND/ha.

- Other annual crop area:

+ Seedling stage (sowing to 1/3 growth time): damage over 70% area, support 6,000,000 VND/ha; damage from 30% to 70% area, support 3,000,000 VND/ha.

+ Development stage plant (1/3 to 2/3 growth time): damage over 70% area, support 10,000,000 VND/ha; damage from 30% to 70% area, support 5,000,000 VND/ha.

+ Pre-harvest stage (over 2/3 growth time): damage over 70% area, support 15,000,000 VND/ha; damage from 30% to 70% area, support 7,500,000 VND/ha.

- Perennial crop area:

+ Gardens during construction: damage over 70% area, support 12,000,000 VND/ha; damage from 30% to 70% area, support 6,000,000 VND/ha.

+ Business gardens that reduce yields without plant death: damage over 70% area, support 20,000,000 VND/ha; damage from 30% to 70% area, support 10,000,000 VND/ha.

+ Business gardens with plant death or assessed as unrecoverable; top line gardens agriculturally exploiting materials: damage over 70% area, support 30,000,000 VND/ha; damage from 30% to 70% area, support 15,000,000 VND/ha.

+ Seedling plants during nursery phase propagated from top line garden materials: damage over 70% area, support 60,000,000 VND/ha; damage from 30% to 70% area, support 30,000,000 VND/ha.

[2] Support levels for forestry damage caused by natural disasters and plant pests:

- Planted forest and non-timber forest product areas on newly planted forestry land to 1/2 exploitation cycle: damage over 70%, support 8,000,000 VND/ha; damage from 30% to 70%, support 4,000,000 VND/ha.

- Planted forest and non-timber forest product areas on forestry land over 1/2 exploitation cycle, large planted forests over 3 years old: damage over 70%, support 15,000,000 VND/ha; damage from 30% to 70%, support 7,500,000 VND/ha.

- Seedling and seed forest areas: damage over 70%, support 20,000,000 VND/ha; damage from 30% to 70%, support 10,000,000 VND/ha.

- Seedling areas in nursery phase:

+ Fast-growing group, under 12 months sowing time: damage over 70%, support 40,000,000 VND/ha; damage from 30% to 70%, support 20,000,000 VND/ha.

+ Slow-growing group, under 12 months sowing time: damage over 70%, support 60,000,000 VND/ha; damage from 30% to 70%, support 30,000,000 VND/ha.

[3] Support levels for aquaculture damage caused by natural disasters (including aquaculture, production, nursing of aquatic breeds):

- Semi-intensive and intensive aquaculture in ponds (lagoons/pits): support 60,000,000 VND/ha damaged area.

- Aquaculture in tanks, cages, rafts: support 30,000,000 VND/100 m³ damaged volume.

- Aquaculture in other forms: support 15,000,000 VND/ha damaged area.

[4] Support levels for livestock damage (death, missing) due to natural disasters:

- Poultry (chickens, ducks, geese, pigeons) up to 28 days old, support from 15,000 VND/bird to 30,000 VND/bird; over 28 days old, support from 31,000 VND/bird to 45,000 VND/bird.

- Quail up to 28 days old, support from 3,000 VND/bird to 5,000 VND/bird; over 28 days old, support from 6,000 VND/bird to 10,000 VND/bird.

- Piglets up to 28 days old, support from 500,000 VND/animal to 600,000 VND/animal; over 28 days old, support from 610,000 VND/animal to 1,500,000 VND/animal; sows and boars being exploited, support 3,000,000 VND/animal.

- Dairy heifers up to 6 months old, support from 2,000,000 VND/animal to 4,000,000 VND/animal; dairy cows over 6 months old, support from 4,100,000 VND/animal to 12,000,000 VND/animal.

- Buffaloes, beef cattle, horses up to 6 months old, support from 1,500,000 VND/animal to 3,000,000 VND/animal; over 6 months old, support from 3,100,000 VND/animal to 7,000,000 VND/animal.

- Sika deer, sheep, goats, ostriches: support from 1,000,000 VND/animal to 2,500,000 VND/animal.

- Rabbits up to 28 days old, support from 30,000 VND/animal to 50,000 VND/animal; over 28 days old, support from 51,000 VND/animal to 70,000 VND/animal.

- Honey bees (colonies): support from 300,000 VND/colony to 500,000 VND/colony.

[5] Support levels for salt production damage due to natural disasters (including ongoing production areas or areas with accumulated salt on fields):

Salt production area: damage over 70%, support 4,000,000 VND/ha; damage from 30% to 70%, support 3,000,000 VND/ha.

[6] In case support is given in plants, animals, or physical goods, the support level is converted equivalent to monetary support according to the price at the time of support.

What activities does the State of Vietnam invest in regarding cultivation?

Based on Article 4 of the Cultivation Law 2018, the State's policy on cultivation activities is regulated as follows:

Article 4. State policy on cultivation activities

  1. The State invests in the following activities:

a) Statistics, investigation, building a database on cultivation activities; market information and forecasting; developing cultivation development strategies; establishing standards, technical regulations on cultivation activities;

b) Building, upgrading infrastructure, equipment for public scientific and technology organizations for policy research, basic research in the cultivation field;

c) Scientific and technological activities specified in point a and point b of clause 2 Article 6 of this Law;

d) Training human resources on agricultural extension for areas with difficult and especially difficult socio-economic conditions.

  1. Depending on the period and the state budget's capability, the State supports the following activities:

a) Production linkage, forming concentrated commodity production areas, organic farming; conversion of crop structure; farming on sloping, low-lying, acidic, saline, sandy coastal land, land at risk of desertification; developing raw material areas for processing plants; managing planting areas and tracing origins;

According to the above regulation, the State invests in the following activities in cultivation:

- Statistics, investigation, building a database on cultivation activities; market information and forecasting; developing cultivation development strategies; establishing standards, technical regulations on cultivation activities.

- Building, upgrading infrastructure, equipment for public scientific and technology organizations for policy research, basic research in the cultivation field.

- Scientific and technological activities as follows:

+ Researching mechanisms and policies in cultivation; selecting and breeding high-quality plants resistant to harmful organisms and adaptable to climate change; exploiting beneficial organisms; developing organic fertilizers, biological products, cultivation techniques, and environmental protection in cultivation; researching soil science and plant nutrition, post-harvest technology.

+ Collecting, conserving, preserving, and exploiting genetic resources of rare, specialty plants, indigenous plants; building a plant gene bank.

- Training human resources on agricultural extension for areas with difficult and especially difficult socio-economic conditions.
