What are responsibilities in making documents, books, documents, information and data to determine the actual mined mineral output in Vietnam?
Pursuant to Article 4 of the Circular 17/2020/TT-BTNMT stipulating responsibilities in making documents, books, documents, information and data to determine the actual mined mineral output in Vietnam as follows:
Organizations and individuals exploiting minerals are responsible for making vouchers, books, documents, information and data to determine the actual mineral production from the beginning of mining until the end, mine closure, including:
1. Prepare, update and manage books, technical documents, vouchers and financial documents specified in Clauses 2 and 3, Article 41 of Decree No. 158/2016/ND-CP and forms statistics issued together with this Circular.
2. Comply with the provisions of Clause 2, Article 42 of Decree No. 158/2016/ND-CP. As for the weighing station, it must be installed in accordance with the topographical and mining conditions of the mine, ensuring control of all primary minerals brought out from the permitted mining area. Types and sizes of scales located at the weighing station are selected in accordance with the scale, capacity and technical infrastructure of the mine; types of mines, types of minerals exploited and vehicles for transporting minerals.
3. Comply with the provisions of Clause 3, Article 42 of Decree No. 158/2016/ND-CP, annual data must be compiled on the actual mined mineral output, including main minerals, accompanying minerals and volume of waste soil (if any) to include in the periodic report on mineral exploitation.
4. Comply with the provisions of Article 43 of Decree No. 158/2016/ND-CP and take responsibility before law for the accuracy of information and data recorded in books, technical documents, invoices, financial documents, statistical forms and other relevant documents to determine the actual mined mineral output.
5. The determination of actual mined mineral output must comply with the process and method specified in this Circular.
What are general requirements when making the current map status and the current cross-sectional drawings in Vietnam?
Pursuant to Article 5 of the Circular 17/2020/TT-BTNMT stipulating general requirements when making the current map status and the current cross-sectional drawings in Vietnam as follows:
1. The mapping of the current status and the drawing of the current cross-section of the mining area must satisfy the following requirements:
a) The current status map is made on the basis of topographic map of VN-2000 coordinate system, axis meridian, projection zone in accordance with the map of mineral mining area enclosed with the mining license; must ensure to fully display the contents according to regulations on surveying and cartography, information related to mineral bodies being exploited in the area permitted for exploitation at the time of establishment. The map has a scale of 1:1,000 or 1:2,000 or 1:5,000;
b) The current cross-sectional drawing is made with the same scale or larger than that of the current map and must show information on the morphology, position and geological structure of the mineral bodies being exploited at the time of establishment;
c) Current status map, current cross-sectional drawing must be presented in the form of paper documents and archived in digitized form; must honestly reflect the actual information and data at the time of establishment. Symbols, forms and contents of elements on the current status map, current cross-section must be consistent with drawings and cross-sections in mineral exploration reports, mineral mining investment projects, mine design has been approved according to regulations.
2. Organizations and individuals that are allowed to exploit minerals directly make current status maps and current cross-sectional drawings when fully meeting the conditions prescribed by the law on surveying and cartography. In case of hiring to make current status maps and current cross-sectional drawings, the surveying contract unit must have the functions and conditions to fully satisfy the conditions prescribed by the law on surveying and cartography, and at the same time bear the responsibility take responsibility before the law for the accuracy of the contents shown on the current status map, current cross-sectional drawing.
When is the time to make the current status map, current cross-sectional drawing and make statistics and inventory of mineral reserves in Vietnam?
Pursuant to Article 6 of the Circular 17/2020/TT-BTNMT stipulating the time to make the current status map, current cross-sectional drawing and make statistics and inventory of mineral reserves in Vietnam as follows:
1. Organizations and individuals exploiting minerals must make current status maps and cross-sectional drawings of the current status of mineral mining areas from the beginning of the basic construction of the mines; during mining until the end of mining (mine closure). Information and data for mapping the current status and cross-sectional drawings of the current state of the mining area annually shall be updated until the end of December 31 of each year and comply with the following regulations:
a) At least once a year for mineral water, natural hot water; exploiting minerals as common building materials with a permitted mining capacity of less than 50,000 m3 of primary minerals/year;
b) At least once every 6 months for the remaining minerals.
2. On the basis of updating information and data of current status maps and current cross-sectional drawings, organizations and individuals permitted to exploit minerals shall make statistics and inventory of mined mineral reserves; evaluate the actual mined mineral reserves and quality compared with the approved exploration results.
3. The time of making statistics and inventory of mineral reserves is the last period in the reporting year. Statistical and inventory data as of the end of December 31 of the year are consistent with the periodical reporting period on mineral exploitation activities. Statistical and inventory reports made according to form No. 01 issued together with this Circular.
