What are regulations on the norm of labor in the economic - technical norms under the management of the Ministry of Natural Resources and Environment in Vietnam?

Pursuant to Article 16 of the Circular 16/2021/TT-BTNMT stipulating the norm of labor in the economic - technical norms under the management of the Ministry of Natural Resources and Environment in Vietnam as follows:

1. Labor norm is the waste of necessary labor time of employees who directly produce a product (or perform a job step or a specific job) and time off with full salary according to the provisions of current law. Direct labor norms include: technical labor; service workers (unskilled workers).

a) Technical labor is a laborer who has been trained in professional skills in the field of natural resources and environment and other related professions as prescribed by law.

Technical labor norm is the waste of direct technical labor time necessary to complete a product (or to perform a job step or perform a specific job), including: and domestic workers, the time off is entitled to full salary according to the provisions of current law.

b) Service labor (unskilled labor) is simple labor for transporting equipment, supplies, specimens, guiding and other activities in the production process to create products.

2. Components of labor norms include:

a) Job content: list job description, basic operations, main operations to perform the job;

b) Determination of standard conditions (classification of difficulty): determine basic factors such as topography, topography, traffic, weather, geology and other conditions related to job performance; define difficulty levels other than standard conditions;

c) Manifest: describe the job position of each worker in each stage and cycle of work until the product is created. On that basis, determine the specific number and level of labor to perform each content of each stage of the work in the labor cycle to the completion of the product;

d) Norm: direct labor time required to complete a product; The unit of calculation is individual work or group work/1 product unit. The level of industrial labor, if the job has service workers (unskilled workers) expressed as a fraction, where the numerator is the level of technical labor (calculated by group work, individual work); The denominator is the level of unskilled labor (calculated by work). Labor norms are determined separately for external and internal business activities.

3. Labor includes: single and group work; working time for a working day is 08 working hours for ordinary workers and 06 working hours for heavy, hazardous and dangerous jobs and especially heavy, toxic and dangerous jobs.

a) Work (individual labor): is the labor for an employee who directly performs a work step to create a product;

b) Group work: is the labor for a group of workers who directly perform a product or work step to create the product;

c) Time off with full salary for direct employees, including: leave, additional leave based on seniority (if any), Tet holiday, meeting, study and training leave) is calculated as 34 days out of a total of 312 working days of one (01) year.

4. Determine the additional labor waste compared to standard conditions, including: natural factors such as topography, topography, traffic, geology and weather. Levels affecting the performance (waste of time) vary from 10% to 20%, especially not more than 30% of adjacent categories, classes and groups.

5. The level of off-site labor when having to stop working due to weather phenomena is specified in the content of norms and applied in accordance with relevant laws.

Pursuant to Article 17 of the Circular 16/2021/TT-BTNMT stipulating the norm of labor tools in the economic - technical norms under the management of the Ministry of Natural Resources and Environment in Vietnam as follows:

1. Determine the need to use the necessary tools in each stage of the work cycle to the completion of the product.

2. Determine the list, types and functions of labor tools according to the needs of use in each stage of the work cycle until the product is completed.

3. Determine the duration of use of labor tools as a basis for determining usage rates:

a) Labor tools: the list and expiry date prescribed by the Ministry of Finance;

b) Types of labor protection: the duration of use of each type according to current regulations of law;

c) Other working tools (glassware, porcelain, plastic, wooden, metal): expiry date from 12 months to 36 months.

4. Determine the level of labor tools: is the waste of labor tools used to produce a unit of product under standard conditions.

5. The norm of working tools is calculated according to the norm of labor using working tools.

Pursuant to Article 18 of the Circular 16/2021/TT-BTNMT stipulating the norm of material consumption in the economic - technical norms under the state management of the Ministry of Natural Resources and Environment in Vietnam as follows:

1. Determine the need to use the necessary materials in each stage of the work cycle to the completion of the product.

2. Determine the list and types of materials according to the needs to be used in each stage of the work cycle until the product is completed.

3. Determine the material consumption level: the consumption level for each type of material to create a product unit or a work step to create a product.
