What are regulations on establishment of the command for fire fighting and rescue in Vietnam?
The establishment of the command for fire fighting and rescue in the Public Security sector is stipulated under Article 16 of Circular 140/2020/TT-BCA as follows:
- The command for fire fighting and rescue is established in the event of a large, complex fire, accident, or incident that is directly commanded by the person as specified in point a or point b of Clause 1, Article 13 of this Circular.
- The composition of the command for fire fighting and rescue includes:
+ The head of the command is the person as specified in point a or point b of Clause 1, Article 13 of this Circular.
+ The deputy head of the command is the person as specified in point b or point c of Clause 1, Article 13 of this Circular of the place where the fire, accident, or incident occurred; the commander of the provincial police agency that manages the area where the fire, accident, or incident occurred.
+ The members are commanders of the department level and equivalent from the Fire and Rescue Police Department and other police units assigned to participate in fire fighting and rescue.
- In case it is deemed necessary, the commander of the People's Security Force may propose that the commander of the armed forces, the commander as specified in Clause 2, Article 37 of the Fire and Rescue Law and Clause 2, Article 16 of Decree 83/2017/ND-CP to participate in the composition of the command for fire fighting and rescue.
The deputy heads and members of the command for fire fighting and rescue perform their duties according to the assignment of the head of the board. They are responsible for the results of the performance of the assigned tasks.
The command for fire fighting and rescue will be dissolved after the fire fighting and rescue mission is completed.

The establishment of the advisory board for fire fighting and rescue is regulated under Article 17 of Circular 140/2020/TT-BCA as follows:
- The person in charge as specified in points a and b of Clause 1, Article 13 of this Circular decides to establish a the advisory board for fire fighting and rescue to assist the command for fire fighting and rescue in operating fire fighting and rescue activities.
- The composition of the advisory board for fire fighting and rescue includes:
+ The head of the board is a commander of the specialized unit of the Fire and Rescue Police Department or the Fire and Rescue Police Department.
+ The deputy head of the board is the commander of the Fire and Rescue Police Department of the locality where the fire, accident, or incident occurred; the commander of the Logistics - Technical Unit of the Fire and Rescue Police Department; the commander of the provincial police agency that manages the area where the fire, accident, or incident occurred.
+ The members are commanders and staff of the specialized units of the Fire and Rescue Police Department; officials responsible for managing the area, the facility where the fire, accident, or incident occurred; persons with strong professional skills in fire fighting and rescue; commanders of the specialized units of the Fire and Rescue Police Department; officials responsible for logistics, political, traffic, and order work of the local police appointed by the commander.
- In case it is deemed necessary, the commander of the People's Security Force may propose that the assistant to the commander of the armed forces; the assistant to the commander specified in Clause 2, Article 37 of the Fire and Rescue Law and Clause 2, Article 16 of Decree 83/2017/ND-CP; representatives of the facility or the person responsible for safety, technical work of the area, the facility where the fire, accident, or incident occurred to participate in the composition of the planning board for fire fighting and rescue.
- The deputy heads and members of the advisory board for fire fighting and rescue perform their duties according to the assignment of the head of the board and are responsible to the head of the board for the results of the performance of the assigned tasks.
