What are organizations, units and individuals participating in the investigation, survey and clearance of mines and explosives in Vietnam?
Article 10 of Circular 195/2019/TT-BQP stipulates organizations, units and individuals participating in the investigation, survey and clearance of mines and explosives as follows:
1. Organizations and units participating in investigation, survey, consulting, supervision and clearance activities must have an establishment decision of a competent state agency or a lawful operation license. In Vietnam and granted a certificate of competence as prescribed, consulting and monitoring organizations may not concurrently carry out demining in the same project, item or task.
2. Individuals who are Vietnamese citizens and foreigners who are allowed to reside and work in Vietnam and undertake jobs directly in contact with landmines, ammunitions and other explosives must be trained and issue specialized certificates of investigation, survey and clearance of mines and explosives (this provision does not apply to individuals in specialized units when performing national defense and security tasks).
What is competence to assign tasks and order of investigation, survey and clearance of mines and explosives in Vietnam?
In Article 11 of Circular 195/2019/TT-BQP stipulating competence to assign tasks and order of investigation, survey and clearance of mines and explosives, as follows:
1. Organizations and units under the Ministry of National Defense are responsible for reporting to the competent authority after being selected by the investor as a unit of investigation, survey and clearance of mines and explosives to be assigned tasks. The authority to assign tasks to investigate, survey and clear mines and explosives is prescribed as follows:
a) The Ministry of National Defense assigns tasks to organizations and units to investigate , survey and clear bombs, mines, and explosives of projects, items and tasks of Groups I and II specified in Clauses 1 and 2 of this Article 3 of this Circular and assign tasks to organizations and units directly under the investigation, survey and clearance of bombs, mines and explosives of projects, items and tasks of Group III specified in Clause 3, Article 3 of this Circular. This;
b) The Command of the Military Region, the Service, the Corps, the High Command of the Border Guard, the High Command of Hanoi Capital, the Command of Engineers assigns tasks to the units under its authority to carry out investigation and investigation. monitoring and clearing bombs, mines and explosives of projects, items and tasks of Group III specified in Article 3 of this Circular.
2. Competence to assign tasks of investigation, survey and clearance of bombs and mines and explosives of other organizations and units shall comply with relevant laws.
3. Order of investigation, survey, and clearance of mines and explosives
a) Making construction plans approved by competent authorities;
b) Notify in writing to the local administration and military agency at district level or higher of the investigation, survey and clearance of mines and explosives;
c) Organize the investigation, survey, clearance, collection, transportation and destruction of bombs, mines and explosives in accordance with the plan, plan and the provisions of law;
d) After completing the investigation, survey and clearance of mines and explosives, the organization or unit must report to the investor for acceptance testing in accordance with the provisions of Vietnam Standard TCVN 10299-3:2014 and area managers have investigated, surveyed and cleared mines and explosives to put them into use. Article 12 of Circular 195/2019/TT-BQP stipulates procedures and responsibilities for collection, transportation and destruction of bombs, mines and explosives collected during investigation as follows :
1. Bombs and explosives discovered in the course of investigation, survey and clearance are types of high danger and must be strictly managed and destroyed during implementation.
2. The process of collecting, transporting and destroying mines and explosives must comply with the provisions of Article 2.4 of the National Technical Regulation QCVN 01:2012/BQP promulgated together with Circular No. 121/2012/TT-BQP November 12, 2012 of the Minister of National Defense.
3. Responsibilities of organizations and units investigating, surveying and clearing mines and explosives
