Must compensation be provided for wind turbines constructed close to residential homes?
According to Article 11 of Circular 02/2019/TT-BCT on the regulations regarding the safety of wind power projects, it is stipulated that:
- The scope of a wind power project includes the areas of wind tower columns, electrical transmission lines, substations, and other auxiliary components. The safety corridor of wind power projects, transmission line safety corridors, and substations must comply with the technical standards and regulations on electrical equipment, regulations on the protection of high-voltage grid projects, and other legal provisions concerning the safety of electrical works.
- Wind power projects must be located at least 300 meters away from residential areas.
- Wind turbine and tower columns must have a light color and be non-reflective.
Therefore, the wind power project is required to be located at least 300 meters away from residential areas (including villages, hamlets, etc.). In the instance where a wind power pole is built 200 meters away from your house, it is considered to not meet the safety distance requirement. Consequently, to ascertain whether compensation can be provided or not, you should present this issue to the commune People's Committee and the construction unit for detailed support on the matter.
