Is It Permissible to Switch Off the Circuit Breaker When the Neighbor Is Singing Karaoke?
Is it allowed to cut off the electricity switch when the neighbor sings karaoke?
Article 7 of the Electricity Law 2004 stipulates the prohibited acts in electricity activities and electricity use as follows:
Destruction of electrical equipment, measuring devices, and electric power projects.
Conducting electrical activities without a license as prescribed by this Law.
3. Illegally connecting or disconnecting electricity.
Violating safety regulations in electricity generation, transmission, distribution, and usage.
Obstructing the inspection of electricity activities and electricity usage.
Stealing electricity.
Using electricity to trap or catch animals, or as a means of protection, except as provided in Article 59 of this Law.
Violating regulations on the protection of the safety corridor of the electricity grid, the safe distance of transmission lines and substations.
Providing false information that damages the legitimate rights and interests of organizations and individuals engaged in electricity activities and using electricity.
Abusing positions and powers to cause harassment, trouble, and illicit gains in electricity activities and usage.
Other acts violating legal regulations on electricity.
According to current regulations, the act of cutting off the circuit breaker of the neighbor is considered illegal.
How to handle the act of singing karaoke that affects public tranquility?
Article 8 of Decree 144/2021/ND-CP specifies the acts violating regulations on ensuring public tranquility as follows:
- A warning or a fine from VND 500,000 to VND 1,000,000 shall be imposed for one of the following acts:
a) Making loud noises, causing disturbance, or commotion in residential areas, public places from 10:00 PM the previous day to 6:00 AM the next day;
b) Failing to comply with regulations on maintaining quietness in medical examination and treatment facilities, nursing homes, schools, or other places required to maintain public tranquility;
c) Selling food and beverages beyond the regulated hours specified by the Provincial People’s Committee or central government cities.
A fine from VND 1,000,000 to VND 2,000,000 shall be imposed for using loudspeakers, gongs, drums, whistles, horns, or other means to create noise in public places without permission from the competent authorities.
Additional penalty:
Confiscation of exhibits and means of administrative violation for the acts specified in Clause 2 of this Article.
