Is a Cooperative a Forest Owner?
According to Clause 9, Article 2 of the Forestry Law 2017, the forest owner includes organizations, households, individuals, and communities that are allocated forests, leased forests; allocated land, leased land to plant forests; self-recover, develop forests; receive transfer, donation, inheritance of forests according to the provisions of the law.
Article 8 of the Forestry Law 2017 prescribes that the subjects as forest owners include:
- Special-use forest management boards, protective forest management boards.
- Economic organizations including enterprises, cooperatives, unions of cooperatives and other economic organizations established and operating according to the provisions of the law, except in cases provided for in Clause 7 of this Article.
- Units belonging to the People's Armed Forces that are allocated forests (hereinafter referred to as armed units).
- Science and technology organizations, training, vocational education in forestry.
- Domestic households and individuals.
- Community communities.
- Enterprises with foreign-invested capital leased land by the State to plant production forests.
Thus, according to the aforementioned regulations, cooperatives can be forest owners.
