How is the Appraisal of Strategic Environmental Assessment Reports Conducted?
The appraisal of the strategic environmental assessment report is conducted in accordance with the provisions of Article 4 of Circular 27/2015/TT-BTNMT regarding strategic environmental assessment, environmental impact assessment, and environmental protection plans issued by the Minister of Natural Resources and Environment. Specifically:
- The appraisal of the strategic environmental assessment report is conducted through an appraisal council established by the head or a leading official of the appraising agency with the following structure and components:
+ The appraisal of the strategic environmental assessment report is carried out through an appraisal council established by the Head or leading official of the agency responsible for organizing the appraisal of the strategic environmental assessment report, with at least nine (09) members.
+ The structure of the appraisal council includes a Chairman, one (01) Deputy Chairman if necessary, one (01) Secretary member, two (02) Peer-review members, and a number of other members. At least thirty percent (30%) of the council members must have at least five (05) years of experience in the field of strategic environmental assessment.
- The operations of the strategic environmental assessment appraisal council are stipulated in Chapter V of this Circular.
- The timeframe for appraising the strategic environmental assessment report is specified in Clause 4, Article 10 of Decree No. 18/2015/ND-CP. In cases where the dossier is incomplete or invalid, the appraising agency must send a written notification to the agency requesting the appraisal of the strategic environmental assessment report to be informed, supplemented, and completed within a maximum of five (05) business days from the date of receipt of the dossier.
