How is the advisory agency for responding to off-site hazardous waste incidents regulated?
Clause 5, Article 10 of the Regulation on Waste Incident Response, issued together with Decision 09/2020/QD-TTg, provides for the advisory agencies on waste incident response outside the facilities as follows:
- The Natural Resources and Environment Office shall take the lead, coordinating with other relevant agencies and units of the district-level People's Committee, to advise on organizing the response to incidents as stipulated in Point b, Clause 1, Article 4 of this Regulation;
- The Department of Natural Resources and Environment shall take the lead, coordinating with other relevant agencies of the provincial-level People's Committee, to advise on organizing the response to incidents as stipulated in Clause 2, Article 4 of this Regulation;
- The Ministry of Natural Resources and Environment shall take the lead, coordinating with the Ministries of Public Security, National Defense, Finance, Industry and Trade, Science and Technology, Agriculture and Rural Development, Health, Information and Communications, and other relevant agencies, to advise on organizing the response to incidents as stipulated in Clauses 3 and 4, Article 4 of this Regulation;
- The agencies specified in Points a, b, and c of this Clause are responsible for providing professional and technical support to the incident response commander and the working group in determining the cause of the incident according to their assigned functions, duties, and authority.
