How is Strategic Environmental Assessment Conducted?
The strategic environmental assessment is conducted in accordance with the provisions of Article 3, Circular 27/2015/TT-BTNMT regarding strategic environmental assessment, environmental impact assessment, and environmental protection plans issued by the Minister of Natural Resources and Environment. Specifically:
- Agencies tasked with developing strategies, planning, and plans under the List of subjects required to conduct strategic environmental assessments as stipulated in Appendix I issued with Decree No. 18/2015/ND-CP are responsible for preparing and submitting documentation for the appraisal of strategic environmental assessment reports in accordance with Clause 2, Article 8, Decree No. 18/2015/ND-CP. Documentation for the appraisal request of strategic environmental assessment reports is directly submitted or sent via postal service to the appraisal agency, consisting of:
+ One (01) written request for the appraisal of the strategic environmental assessment report following the form prescribed in Appendix 1.1 of this Circular;
+ Nine (09) copies of the strategic environmental assessment report and nine (09) copies of the draft strategy, planning, or plan. In cases where the number of appraisal council members exceeds nine (09), the agency tasked with developing the strategy, planning, or plan must provide additional copies of the strategic environmental assessment report. The form of the cover page, sub-cover page, and requirements regarding the structure and content of the strategic environmental assessment report shall follow the corresponding templates prescribed in Appendices 1.2 and 1.3 of this Circular.
- In the case of adjustments to strategies, planning, and plans as stipulated in Clause 4, Article 8, Decree No. 18/2015/ND-CP:
+ The agency drafting the strategy, planning, and plan must send to the Ministry of Natural Resources and Environment one (01) explanation document detailing the adjustments to the strategy, planning, or plan as well as related environmental issues, accompanied by one (01) draft of the adjusted strategy, planning, or plan;
+ Within twenty (20) working days, the Ministry of Natural Resources and Environment is responsible for reviewing and providing written feedback to the agency drafting the strategy, planning, or plan and the approving agency of the strategy, planning, or plan.
