Environmental Protection Measures for Livestock and Poultry Breeding Facilities: Regulations and Guidelines
Environmental protection measures for livestock and poultry farming establishments are stipulated in Section II of Decision 397/QD-CN-MTCN in 2017, which provides Guidance on Environmental Protection Plans in Concentrated Farming Areas, issued by the Director of the Department of Livestock Production. Specifically:
Livestock and poultry farming establishments with a farm area of 1,000m2 or more must have an environmental impact assessment report.
- The dossier for appraising the environmental impact assessment report is stipulated in Article 6 of Circular No. 27/2015/TT-BTNMT dated May 29, 2015, by the Ministry of Natural Resources and Environment, regulating strategic environmental assessment, environmental impact assessment, and environmental protection planning.
- The dossier for appraising the environmental impact assessment report should be sent to the Department of Natural Resources and Environment for review and appraisal.
- For livestock establishments that have officially commenced operations but do not have an approved environmental impact assessment report before April 1, 2015, a detailed environmental protection plan must be in place before April 1, 2018.
+ The dossier for appraising and approving a detailed environmental protection plan is stipulated in Article 4 of Circular No. 26/2015/TT-BTNMT dated May 28, 2015, by the Ministry of Natural Resources and Environment, regulating detailed and simplified environmental protection plans.
+ The dossier for appraising and approving a detailed environmental protection plan should be sent to the Department of Natural Resources and Environment.
Livestock and poultry farming establishments with a farm area from 50m2 to under 1,000m2 must have an environmental protection plan.
- The dossier for registering the environmental protection plan is stipulated in Article 33 of Circular No. 27/2015/TT-BTNMT dated May 29, 2015, by the Ministry of Natural Resources and Environment, regulating strategic environmental assessment, environmental impact assessment, and environmental protection planning.
- The dossier for registering the environmental protection plan should be sent to the district-level or commune-level People's Committee, which the district-level People's Committee considers and authorizes to confirm registration of the environmental protection plan.
- For livestock establishments that have officially commenced operations before April 1, 2015, and do not have an environmental protection commitment, a simplified environmental protection plan must be in place before April 1, 2018.
+ The dossier for registering the simplified environmental protection plan is stipulated in Article 11 of Circular No. 26/2015/TT-BTNMT dated May 28, 2015, by the Ministry of Natural Resources and Environment, regulating detailed and simplified environmental protection plans.
+ The dossier for registering the simplified environmental protection plan should be sent to the district People's Committee.
When there is a change in the size of the farm, the owner of the livestock establishment is responsible for applying supplementary environmental protection measures suitable for the type and number of livestock, ensuring compliance with the regulations.
