Based on Official Telegram 1170/CD-BGDDT in 2024 proactively responding to Typhoon No. 3 as follows:

According to the National Center for Hydro-Meteorological Forecasting, at 16:00 on September 03, 2024, the eye of Typhoon No. 3 (Yagi) was on the eastern sea area of the North East Sea, with the strongest wind near the typhoon's center reaching level 10 (89 - 102km/h), gusting to level 12. It is forecasted that Typhoon No. 3 has the potential to directly hit the northern provinces with very strong intensity, especially in the provinces and cities: Quang Ninh, Hai Phong, Thai Binh, Nam Dinh, Ha Nam, Ninh Binh. To proactively respond to Typhoon No. 3, the Minister of Education and Training requires Directors of Education and Training Departments of northern provinces/cities from Nghe An outward to seriously implement the following tasks:

1. Closely monitor the developments of the Typhoon, be on duty 24/24 hours; maintain regular contact with authorities and local rescue forces to promptly respond in case of emergencies, implementing the "4 on-site" principle;

2. Direct educational institutions to organize the opening ceremony of the new school year in a concise, safe manner, suitable to the actual conditions of the locality. Absolutely do not hold opening ceremonies in areas with heavy rain at risk of landslides or flooding;

Accordingly, Typhoon No. 3 Yagi can potentially directly hit the northern provinces with very strong intensity, especially in the provinces and cities: Quang Ninh, Hai Phong, Thai Binh, Nam Dinh, Ha Nam, Ninh Binh.

How is the Salary for Workers Stopping Work Due to Typhoon No. 3 Yagi Paid?

Based on Article 99 of the Labor Code 2019 stipulating the pay for stoppage time:

Article 99. Pay for Stoppage Time

In cases of stoppage, the worker is paid as follows:

  1. If due to the employer's fault, the worker is paid the full salary according to the labor contract;
  1. If due to the worker's fault, that worker is not paid; other workers in the same unit who have to stop working are paid according to the rate agreed by the two parties but not lower than the minimum wage;
  1. If due to power, water issues not caused by the employer's fault or due to natural disasters, fires, dangerous epidemics, enemy sabotage, relocation of the operation site at the request of competent state authorities or for economic reasons, the two parties agree on the pay for stoppage time as follows:

a) If the stoppage is 14 working days or less, the pay for stoppage time is agreed upon but not lower than the minimum wage;

b) If the stoppage exceeds 14 working days, the pay for stoppage time is agreed upon by the two parties but the pay for the first 14 days must not be lower than the minimum wage.

Therefore, if workers have to stop working due to Typhoon No. 3 Yagi, the pay for stoppage time is determined through mutual agreement as follows:

- If the stoppage is 14 working days or less, the pay for stoppage time is agreed upon but not lower than the minimum wage;- If the stoppage exceeds 14 working days, the pay for stoppage time is agreed upon by the two parties but must ensure the pay for the first 14 days is not lower than the minimum wage.

What Level Must a Typhoon Reach to be Considered a Super Typhoon in Vietnam?

Based on Clause 7, Article 5 of Decision 18/2021/QD-TTg stipulating as follows:

Article 5. Explanation of Terms

In this Decision, the following terms are understood as below:

4. Gust is wind with an instantaneous speed increase, determined over a 2-second interval.

5. Strong wind at sea is wind with a speed of level 6 or higher occurring at sea, determined as an average over a 2-minute observation period (measured in Beaufort wind scale levels).

6. A tropical depression is a tropical cyclone with the maximum wind speed from level 6 to level 7 and possibly with gusts (Appendix III of this Decision).

7. A typhoon is a tropical cyclone with the maximum wind speed from level 8 and can have gusts. A typhoon with the maximum wind speed from level 10 to level 11 is called a strong typhoon, from level 12 to level 15 is called a very strong typhoon, and from level 16 and above is called a super typhoon (Appendix III of this Decision).
