Will the situation of spam SIM cards and SIM cards with incorrect subscriber information be resolved before September 30, 2023 in Vietnam?
On September 10, 2023, the Vietnamese government issued Resolution 144/NQ-CP of 2023 on the Regular Meeting of the Government in August 2023. The resolution includes some information on the economic and social situation in August and the first 8 months of 2023, as well as tasks assigned to ministries, agencies, and localities, especially their leaders, based on their functions, tasks, and powers.
The government requires the Ministry of Information and Communications to take the lead in coordinating the implementation of measures to address the issue of spam SIM cards. The specific requirements are as follows:
20. The Ministry of Information and Communications shall coordinate with relevant agencies and localities to:
...
c) Submit a monthly report on national digital transformation to the government, covering the development of e-government, digital government, digital economy, and digital society (replacing the “Report on the implementation of the Resolution No. 17/NQ-CP dated March 7, 2019 of the Government on some key tasks and solutions to promote the development of e-government”).
d) Coordinate with the Central Committee of Propaganda and Education to continue directing key media outlets to increase the prominence of information on the decisions of the Party, the State, and the government’s leadership and management work to address difficulties and obstacles in terms of mechanisms and policies, creating momentum for economic and social development.
đ) Coordinate closely with the Ministry of Public Security to resolve the issue of SIM cards with incorrect subscriber information (spam SIM cards) before September 30, 2023.
e) Expedite discussions with the Ministry of Planning and Investment, the Ministry of Industry and Trade, the Ministry of Finance, and relevant agencies on the proposal to issue the National Program to support small and medium-sized enterprises in using digital technology to innovate in management and production and business, and to agree on the lead agency in developing the program, and report to the Prime Minister before September 20, 2023.
In summary, one of the key tasks that the government requires the Ministry of Information and Communications to coordinate with the Ministry of Public Security to complete is to address the issue of spam SIM cards before September 30, 2023. Spam SIM cards can be understood as SIM cards with incorrect subscriber information.
What are the contents of subscriber information in Vietnam?
According to Clause 5 Article 15 of Decree 25/2011/ND-CP (amended by Article 1 of Decree 49/2017/ND-CP), the contents of subscriber information are as follows:
(1) Subscription number.
(2) Object of use for each subscription number:
- For individuals: for themselves; for children under 14 years old; for the ward; for the devices.
- For organizations: for individuals in the organization; for the devices.
(3) Information on the identity card of an individual, including:
- Full name;
- Date of birth;
- Nationality;
- Number, date of issue, issuing authority or place of issue of identity card: citizen identification card
- Place of permanent residence (for Vietnamese citizens).
(4) Information on the organization's documents, including:
- Organization name;
- Business address;
- Information on the identity card of the person who comes to conclude the sample contract, general terms and conditions of transaction and information on the identity card of each individual in the organization corresponding to the subscription number that the organization gives to that individual to use (in case the organization gives to the user).
(5) Digitized version of all documents of individuals and organizations presented when concluding the sample contract, general terms and conditions of transaction;
(6) Photograph of the person who directly goes to conclude the sample contract, general terms and conditions of transaction (for mobile telecommunications services).
- Digitized version of the subscriber information confirmation form or the subscriber information confirmation form with an electronic signature (for prepaid mobile telecommunications services).
(7) Payment method: prepaid or postpaid.
(8) Name of the transaction officer.
- Time of concluding the sample contract, general terms and conditions of transaction;
- Time of each update of subscriber information (in cases where individuals or organizations update their subscriber information).
- Address and contact number of the telecommunications service provider.
Where to register subscriber information in Vietnam?
According to Clause 1 Article 15 of Decree 25/2011/ND-CP (amended by Article 1 of Decree 49/2017/ND-CP), the registration of subscriber information is carried out through the conclusion of a sample contract on the use of subscriber information and practice at telecommunications service providing locations, specifically:
- Telecommunications service providing location with a fixed address established by the telecommunications enterprise.
- Mobile telecommunications service providing location established by the telecommunications enterprise.
- Authorized telecommunications service providing location.
