Promulgation of the 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools?
On June 29, 2024, the National Assembly promulgated the 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools.
The 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools will stipulate issues such as:
- Regulations on the management and use of weapons, explosives, explosive precursors, and supporting tools;
- Principles and responsibilities of agencies, organizations, and individuals in the management and use of weapons, explosives, explosive precursors, and supporting tools to protect national security, ensure order, social safety, protect human rights, citizen rights, and serve socio-economic development.
The 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools takes effect from January 1, 2025. Except for Article 17, Article 32, and Clause 1 Article 49 of the 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools, which take effect from July 1, 2025.

What conditions must a person authorized to use weapons meet?
According to Article 6 of the 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools, the conditions and responsibilities of a person authorized to use weapons, explosives, and supporting tools are stipulated as follows:
Conditions and responsibilities of a person authorized to use weapons, explosives, and supporting tools
1. A person authorized to use weapons, explosives, and supporting tools must ensure the following conditions:
a) Be fully capable of civil acts;
b) Have good ethical qualities and sufficient health suitable to the assigned job;
c) Have been trained in the use of weapons, explosives, and supporting tools and granted a certificate of use of weapons, explosives, and supporting tools, except for those in the People's Army, Coast Guard, People's Public Security who have been trained in the use of weapons, explosives, and supporting tools and authorized to use by competent authorities;
d) Not be under administrative measures, not be prosecuted for criminal responsibility; in case of being convicted under a court judgment or decision, they must have their criminal records expunged.

Thus, the conditions that a person authorized to use weapons must meet are:
- Be fully capable of civil acts
- Have good ethical qualities and sufficient health suitable to the assigned job
- Have been trained in the use of weapons and granted a certificate of use of weapons, except for those in the People's Army, Coast Guard, People's Public Security who have been trained in the use of weapons and authorized to use by competent authorities
- Not be under administrative measures, not be prosecuted for criminal responsibility; in case of being convicted under a court judgment or decision, they must have their criminal records expunged.
Who are the subjects that can be equipped with military weapons?
According to Clause 1 Article 18 of the 2024 Law on Management and Use of Weapons, Explosives, and Supporting Tools, the subjects that can be equipped with military weapons are stipulated as follows:

- Subjects that can be equipped with military weapons include:
a) People's Army;
b) Militia and self-defense forces;
c) Coast Guard;
d) People's Public Security;
dd) Cryptographic agencies;
e) Investigation agencies of the Supreme People's Procuracy;
g) Forest rangers, Fisheries surveillance force;
h) Aviation security;
i) Border customs; specialized anti-smuggling forces of customs; anti-drug crime forces of customs.
The Minister of National Defense shall stipulate the equipping of military weapons for subjects under the management of the Ministry of National Defense that have the characteristics, requirements, and tasks pertaining to the People's Army, Militia and self-defense forces, Coast Guard, and Cryptographic agencies.
The Minister of Public Security shall stipulate the equipping of military weapons for subjects not under the management of the Ministry of National Defense that have the characteristics, requirements, and tasks.
Thus, the subjects that can be equipped with military weapons are:
- People's Army;
- Militia and self-defense forces;
- Coast Guard;
- People's Public Security;
- Cryptographic agencies;
- Investigation agencies of the Supreme People's Procuracy;
- Forest rangers, Fisheries surveillance force;
- Aviation security;
- Border customs; specialized anti-smuggling forces of customs; anti-drug crime forces of customs.
