What is legal responsibility? What are characteristics, and classification of legal responsibility in Vietnam?

Currently, there is no legal document defining what legal responsibility is. However, legal responsibility is considered a special legal relationship between the State (through authorized officials and competent state agencies) and the subject of law violation.

In this relationship, the State has the right to apply coercive measures with punitive nature as stipulated in the sanctions of the legal norm against the violating subject, and this subject has the obligation to bear the adverse consequences caused by their behavior.

Legal responsibility has three characteristics:

- The factual basis of legal responsibility is the violation of the law.

- The legal basis of legal responsibility is the legally effective legal document issued by the competent state agency.

- Legal responsibility is closely related to State coercion.

Based on the classification of legal violations, there are four types of legal responsibility:

- Criminal responsibility.

- Civil responsibility.

- Administrative responsibility.

- Disciplinary responsibility.

What is the role of the State of Vietnam in legal dissemination and education?

Article 3 of the Law on Legal dissemination and Education 2012 stipulates the state's policy on legal dissemination and education as follows:

State Policy on Legal issemination and Education

1. legal dissemination and education are the responsibilities of the entire political system, with the State playing the core role.

2. The State ensures the necessary resources for legal dissemination and education work.

3. Implement private investment in legal dissemination and education; reward agencies, organizations, and individuals who make positive contributions to legal dissemination and education work.

4. Legal education in educational institutions of the national education system is integrated into the education programs of different levels and training levels; it is a content in the education program of secondary education, high school education, vocational education, higher education.

Thus, the state plays a core role in implementing policies on legal dissemination and education. The State ensures necessary resources for legal dissemination and education work.

What are regulations on state management on legal dissemination and education in Vietnam?

Based on Article 6 of the Law on legal dissemination and Education 2012, the state management of legal dissemination and education is regulated as follows:

- The content of state management on legal dissemination and education includes:

+ Formulate and promulgate legal normative documents, programs, and plans on legal dissemination and education;

+ Direct, guide and organize the implementation of legal dissemination and education;

+ Provide training in legal knowledge and legal dissemination and education practice;

+ Construct and manage the national legal database;

+ Statistics, summarize legal dissemination and education;

+ Inspect, supervise, resolve complaints, denunciations, and handle violations in legal dissemination and education;

+ International cooperation on legal dissemination and education.

- The state management agencies on legal dissemination and education include:

+ The Government of Vietnam uniformly manages state affairs in legal dissemination and education;

+ The Ministry of Justice is responsible to the Government of Vietnam for state management in legal dissemination and education; leads the formulation and submission to the Prime Minister of the Government of Vietnam for promulgation of long-term and medium-term programs and plans on legal dissemination and education; leads the construction of the national legal database;

+ Ministries and ministerial-level agencies, within their duties and powers, are responsible for cooperating with the Ministry of Justice in implementing state management on legal dissemination and education;

+ People's Committees at all levels are responsible for implementing state management on legal dissemination and education locally.

What is the function of the Coordination Council for Legal Dissemination and Education in vietnam?

Article 7 of the Law on legal dissemination and Education 2012 provides:

1. The Coordination Council for Legal Dissemination and Education is established at the central, provincial, municipal level, district, urban district, district-level town, city under the province, as a consulting body for the Government of Vietnam, People's Committees at the provincial and district levels in legal dissemination and education and mobilizing resources for legal dissemination and education.

2. The standing agency of the Coordination Council for Legal Dissemination and Education of the Government of Vietnam is the Ministry of Justice, of the People's Committee at the provincial level is the Department of Justice, of the People's Committee at the district level is the Division of Justice.

3. The Prime Minister of the Government of Vietnam specifies the composition and duties, powers of the Coordination Council for Legal Dissemination and Education.

Thus, the function of the Coordination Council for Legal Dissemination and Education is to advise the Government of Vietnam, People's Committees at the provincial and district levels on legal dissemination and education and mobilizing resources for legal dissemination and education.
