What are the procedures for establishing a boarding ethnic secondary school in Vietnam?

Under Article 54 of Decree 125/2024/ND-CP, the procedures for establishing a boarding ethnic secondary school in Vietnam are specified as follows:

(1) The Chairman of the provincial People's Committee decides on the establishment of a boarding ethnic secondary school.

(2) The application includes:

- The application form for school establishment (according to Form No. 01 in Appendix 1 attached to Decree 125/2024/ND-CP);

- The school establishment scheme (according to Form No. 02 in Appendix 1 attached to Decree 125/2024/ND-CP).

(3) Procedures:

Step 1: The Department of Education and Training takes charge of and cooperates with relevant agencies to develop the school establishment scheme; compiles the application as prescribed in (2) and submits to the Chairman of the provincial People's Committee for consideration and decision;

Step 2: Within 15 days from the date of receiving a complete and valid application, the Chairman of the provincial People's Committee inspects the establishment eligibility of the school in the application; if the conditions are satisfied, decides to establish the boarding ethnic secondary school; if not, notifies the relevant agencies in writing and specifies the reasons.

What are the procedures for issuing an operating license to a boarding ethnic secondary school in Vietnam?

According to Article 56 of Decree 125/2024/ND-CP, the procedures for issuing an operating license to a boarding ethnic secondary school in Vietnam are prescribed as follows:

(1) The Head of the Education and Training Division decides to issue an operating license to a lower-secondary boarding ethnic school; the Director of the Department of Education and Training decides to issue an operating license to a boarding ethnic secondary school with the highest education level being upper secondary.

(2) The application includes:

- The application form for issuing an operating license (according to Form No. 03 in Appendix 1 attached to Decree 125/2024/ND-CP);

- Copies of legal documents proving land use rights, ownership of the building or lease agreements of the school location with a minimum term of 05 years;

- Regulations on organization and activities of the school, including key contents: Legal status, tasks, and powers of the school; organization and management of the school; organization of educational activities in the school; duties and rights of management staff, teachers, staff, workers, and students; finance and assets of the school; other matters related to the organization and activities of the school.

(3) Procedures:

Step 1: The school sends 01 application prescribed in (2) via the online public service portal or postal service or directly to the Education and Training Division (if it is a lower-secondary boarding ethnic school) or the Department of Education and Training (if it is a boarding ethnic secondary school with the highest education level being upper secondary);

Step 2: Within 05 working days from the date of receiving a complete application, the Education and Training Division or the Department of Education and Training notifies in writing the contents needing amendment or supplementation in case the application is invalid; or informs the plan for field assessment at the school in case the application is valid;

Step 3: Within 20 days of receiving a complete and valid application, the Education and Training Division or the Department of Education and Training takes charge of and cooperates with specialized units concerned to organize a field assessment of the educational operation conditions of the boarding ethnic secondary school; compiles an assessment report to evaluate compliance with the regulations in Article 55 of Decree 125/2024/ND-CP;

Step 4: Within 05 working days from the date of the assessment report, if conditions are met, the Head of the Education and Training Division or the Director of the Department of Education and Training decides to issue an operating license to the boarding ethnic secondary school; if conditions are not met, notifies the school in writing and states the reasons.

The decision to issue an operating license to the boarding ethnic secondary school (according to Form No. 10 in Appendix 1 attached to Decree 125/2024/ND-CP) is publicly announced in the mass media.
