Based on Clause 2, Article 5 of the Regulation on the organization and operation of regional universities and member higher education institutions issued together with Circular 10/2020/TT-BGDDT, the regional university council has responsibilities and powers as stipulated by the Law on Higher Education Amendment 2018, Decree 99/2019/ND-CP, and to perform the following responsibilities and powers:

- Regulate the standards, number of terms, and delegation of authority of the chairman of the regional university council; standards, duties, powers, and procedures for electing and dismissing the vice-chairman (if any) and secretary of the regional university council; number and structure of members; supplement or replace members; and the form of decisions for each type of activity of the regional university council.

- Prescribe procedures by which the regional university council decides on personnel for the director, the process of appointing other management positions under the jurisdiction of the regional university; grounds and procedures for proposing the dismissal of the director; number of deputy directors under the decision-making authority of the regional university; maximum tenure of the director, deputy director, and other managerial positions within the regional university.

- Regulate the operational budget, permanent agency, supervisory body, working apparatus of the regional university council; procedures and components of delegate conferences; and other regulations as required by the regional university council.

- Define responsibilities and powers between the regional university council and the director; the relationship between the regional university council and the councils of member universities, affiliated, and autonomous units within the regional university.

- Mandate the representation of the regional university to participate in the university council of member universities.

Who has the authority to recognize the Director of a regional university in Vietnam?

Based on Clause 1, Article 6 of the Regulation on the organization and operation of regional universities and member higher education institutions issued together with Circular 10/2020/TT-BGDDT, the regulations regarding the director of a regional university are as follows:

Director of the Regional University

1. The director of a regional university is decided by the regional university council and submitted to the Minister of Education and Training for recognition, dismissal, and relief from duty as per the regulations.

2. The term or appointment period of the director; standards for the director; duties, and powers of the director are carried out as stipulated in Clause 14, Article 1 of the Law amending and supplementing certain articles of the Law on Higher Education (amending and supplementing Article 20 of the Law on Higher Education) and these Regulations.

3. Issue a list of job positions, standards, and working conditions for each position within affiliated units after approval by the regional university council; decide on the appointment of professors, associate professors for eligible lecturers as per the law.

4. Decide on appointing or changing work titles for lecturers, senior lecturers, researchers, senior researchers, specialists, and senior specialists in the entire regional university according to legal provisions.

5. Decide on extending working time, regular wage increase, retirement for senior lecturers based on proposals from member and affiliated units according to the decentralization of the Minister of Education and Training and legal regulations.

Thus, the Director of a regional university is recognized by the Minister of Education and Training.

What are the duties and powers of a regional university in Vietnam?

Based on Article 19 of the Regulation on the organization and operation of regional universities and member higher education institutions issued together with Circular 10/2020/TT-BGDDT, the regional university has the following duties and powers:

- Develop and promulgate regulations for managing international cooperation activities of the regional university in compliance with legal provisions; guide member units in implementing regulations on international cooperation activities.

- Develop international cooperation plans, negotiate, sign, and implement international cooperation agreements on education, training, scientific research, and technology transfer; manage and implement international cooperation programs and projects as per the law.

- Work directly with competent State management agencies to handle procedures related to the entry and exit for public employees, learners, and foreign guests of the regional university according to legal provisions.

- Manage public employees and learners of the regional university going abroad for study, internships, teaching, scientific research, academic exchanges, attending conferences, seminars and other international cooperation activities in compliance with the law.

- Manage delegations, individuals, foreign organizations, and overseas Vietnamese coming to the regional university for teaching, studying, scientific research, technology transfer, and teaching experience exchange as per the law.

- Cooperate with relevant units to effectively implement and ensure security in international cooperation activities and perform other international cooperation tasks according to legal provisions.
