Instructions for filling out the Form of Judicial Record Card No. 1 for teachers according to Form No. 06/2024/LLTP stipulated in the Appendix issued together with Circular 06/2024/TT-BTP are as follows:

Information No. (1): write clearly in uppercase letters with full diacritics.

Information No. (4): clearly state the province/city directly under the Central Government.

Information No. (6): specify whether it is an identification card, citizen identification card, national identification card, identity certificate, or passport. In case of a national identification card or identity certificate, or minors, state the personal identification number.

Information No. (7) and (8): clearly state permanent residence and temporary residence; if there is no permanent residence, state the temporary residence at the time of requesting the judicial record statement; if there is no permanent or temporary residence, fill “//”.

Information No. (10): If there is no request for confirmation of a ban on holding positions, establishing, managing enterprises, or cooperatives, do not fill in the Judicial Record Card No. 1.

Information No. (11): The head of the agency managing the judicial record database or the authorized person signs, writes their full name, and stamps in case of issuing the judicial record in paper form; signs digitally according to the law regulations in case of issuing the judicial record electronically.

How much is the fee for issuing Judicial Record Card No. 1 for teachers in Vietnam?

According to Article 4 of Circular 244/2016/TT-BTC, Vietnamese citizens and foreigners must pay a fee when submitting the application for the issuance of a judicial record card as follows:

Fee rates

The fee for providing judicial record information is as follows:

In case the applicant proposes issuance of more than 02 judicial record cards in one request, the fee collector may collect an additional 5,000 VND/card from the 3rd card onwards to cover the necessary costs for printing the judicial record card forms.

Additionally, Article 4 of Circular 244/2016/TT-BTC is guided by Section 1 of Official Dispatch 44/TTLLTPQG-HCTH 2017 as follows:

1. Regarding the fee rates

According to the provisions of Article 4 of Circular 244, the fee for providing judicial record information is 200,000 VND/time/person; for students, people with meritorious services to the revolution, relatives of martyrs (biological father, biological mother, spouse, biological child, adopted child, and caregiver of the martyr) is 100,000 VND/time/person. In case the applicant proposes issuance of more than 02 judicial record cards in one request, the fee collector may collect an additional 5,000 VND/card from the 3rd card onwards to cover the necessary costs for printing the judicial record card forms.

In case the applicant proposes issuance of 02 types of judicial record cards in one request (judicial record card No. 1 and judicial record card No. 2), the Department of Justice also applies the aforementioned fee rates.

Therefore, the fee for issuing Judicial Record Card No. 1 for teachers is 200,000 VND/time/person.

The fee for issuing Judicial Record Card No. 1 for people with meritorious services to the revolution and relatives of martyrs (including biological father, biological mother, spouse, biological child, adopted child, and caregiver of the martyr) is 100,000 VND/time/person.

In case the applicant proposes the issuance of more than 02 judicial record cards in one request, the fee collector may collect an additional 5,000 VND/card from the 3rd card onwards.

Which authorities have the competence to issue the Judicial Record Card No. 1 for teachers in Vietnam?

According to Clause 2, Article 44 of the Law on Judicial Records 2009, the competence to issue judicial record cards is as follows:

- The National Center for Judicial Records shall issue judicial record cards to the following persons:

+ Vietnamese citizens whose places of permanent or temporary residence are unidentifiable;

+ Foreigners who resided in Vietnam.

- Provincial-level Justice Departments shall issue judicial record cards to the following persons:

+ Vietnamese citizens permanently or temporarily residing in Vietnam;

+ Vietnamese citizens currently residing overseas;

+ Foreigners currently residing in Vietnam.

- The Director of the National Center for Judicial Records, directors of provincial-level Justice Departments or their authorized persons shall sign judicial record cards and take responsibility for their contents.

When necessary, the National Center for Judicial Records and provincial-level Justice Departments shall verify the conditions on automatic remission of previous criminal convictions upon issuance of judicial record cards.

- The issuance of judicial record cards must be recorded in judicial record card issuance books made according to a form set by the Minister of Justice.
