What is an independent preschool class in Vietnam?

According to Article 26 of the Law on Education 2019, the regulations on preschool education institutions are as follows:

Institutions of preschool education include:

1. Junior kindergarten centers and classes for children aged 03 – 36 months;

2. Senior kindergartens and independent senior kindergarten classes for children aged 03 – 06 years;

3. Combined kindergartens and independent preschool classes for children aged 03 months – 06 years.

In addition, according to Article 2 of the Regulations on the organization and operation of independent daycare groups, independent kindergarten classes, independent preschool classes in people-founded and private forms, promulgated together with Circular 49/2021/TT-BGDDT:

Independent preschool education institution is a type of preschool education institution in the national education system that investors or community invest facilities therein and maintain its eligibility for operation.

How many duties must an independent preschool class in Vietnam perform?

According to Article 3 of the Regulations on the organization and operation of independent daycare groups, independent kindergarten classes, independent preschool classes in people-founded and private forms, promulgated together with Circular 49/2021/TT-BGDDT, an independent preschool class must perform the following duties:

(1) Make a plan for implementation of the preschool education program issued by the Minister of Education and Training; mobilize, use, and manage resources to fulfill the goal of preschool education; and promote the cause of education together with the State and meet the requirements of society.

(2) Take care of and educate children from 03 months to 06 years old in conformity with the preschool education program.

(3) Ensure that children may exercise their rights and fulfill their obligations.

(4) Manage and train teachers and staff; childcare workers; ensure quality of children’s care and education and children’s physical and mental safety.

(5) Manage children; provide mainstream education for children in special circumstances, children with disabilities (if any).

(6) Send periodical and ad-hoc reports as regulated and at the requests of relevant authorities.

(7) Discharge other duties and exercise other rights in compliance with prevailing laws.

What are the standards for teachers in an independent preschool class in Vietnam?

According to Article 13 of the Regulations on the organization and operation of independent daycare groups, independent kindergarten classes, independent preschool classes in people-founded and private forms, promulgated together with Circular 49/2021/TT-BGDDT, teachers in an independent preschool class must meet the following standards:

* Qualifications

- Teachers and staff in an independent preschool education institution must meet all standards for professional ethics; academic education; proficiency and fitness as prescribed.

- Teachers must be trained in mainstream education for children with disabilities (if children with disabilities are admitted).

* In addition to these standards, teachers in an independent preschool class must also perform the following duties:

- Ensure that children are physically and mentally safe during their stay in the independent preschool education institution;

- Take care of and educate children in conformity with the preschool education program;

- Preserve the virtue, dignity, and prestige of a teacher; give fair treatment and respect personality of children; protect legitimate rights and interests of children; show solidarity and support to colleagues; follow the code of conduct for teachers; regulations on teachers' ethics as prescribed;

- Help parents and guardians build their scientific knowledge of parenting practices; actively coordinate with families of children to take care of and educate children;

- Self-learn and improve professional practices in children’s care and education;

- Comply with regulations of the independent preschool education institution and other regulations of law.

* Note: In addition to the above duties, teachers and staff of independent preschool education institutions must also perform duties according to their employment contracts signed with the owner of the independent preschool education institution.
