Can a 6th grade lower secondary school student who dropped out for 2 years due to difficult family circumstances return to school?

First, regarding the age of secondary school students, according to Article 33 of the lower secondary school, upper secondary school and multi-level school charter issued together with Circular 32/2020/TT-BGDDT of the Ministry of Education and Training of Vietnam, the secondary school age is specified as follows:

we refer to Article 33 of the Regulation on Secondary Schools, High Schools, and Schools with Multiple Levels issued with Circular 32/2020/TT-BGDDT which regulates the age of students in secondary schools as follows:

Secondary school age

1. Children shall start the sixth grade at the age of 11 and the tenth grade at the age of 15. For students skipping a grade or over-age students, the sixth grade and tenth grade starting ages shall be adjusted based on the age at which these students graduate from the previous education level.

2. For ethnic minority students, students with disabilities, disadvantaged students and students returning to Vietnam from abroad, maximum secondary school starting age shall be 03 years older than the compulsory starting age.

3. At an education level, students may not repeat a grade more than 03 times.

4. Students with good physical capacity and early intelligence development may enter the sixth or tenth grade before the compulsory starting age or skip to the next grade within the same education level. Consideration shall be given on a case-by-case basis and in accordance with the following procedures:

a) The student’s parent or guardian submits an application to the school.

b) The school principal establishes a survey and advisory council with the following main members: representatives of school leaders and parent committee of the school; and teachers teaching the student's class.

c) The school principal considers and makes a decision based on the result of the survey conducted by the survey and advisory council.

5. Students at an appropriate age returning to Vietnam from abroad and children of foreigners working in Vietnam may enroll in local or non-local secondary schools capable of receiving them. Consideration shall be given on a case-by-case basis and in accordance with the following procedures:

a) The student’s parent or guardian submits an application to the school.

b) The school principal organizes an assessment of the student’s capacity and places them in a suitable class.

The age for students enrolling in Grade 6 is 11. The age for students enrolling in Grade 10 is 15.

In the case of a Grade 6 secondary school student who drops out for 2 years, they would be 13 years old and still within the regulated age for their educational level.

Additionally, accordind to Clause 2 Article 4 of the Regulation on school change and admittance of pupils to learn at junior and senior secondary schools issued together with Decision 51/2002/QD-BGDDT of the Ministry of Education and Training of Vietnam, re-study application is prescribed as follows:

Subjects of school change and re-study application

1. School change:

a/ Pupils changing their place of residence together with their fathers, mothers or guardians.

b/ Pupils meeting with extreme family difficulties or having truly plausible reasons for school change.

2. Re-study application:

Pupils applying for re-study after a duration of staying away from school, who are still in the age group prescribed for each educational level.

Students can request re-admission after a break if they are still within the regulated age for the educational level.

Thus, based on the above regulations, a Grade 6 secondary school student who drops out for 2 years will be 13 years old and still within the regulated age for their educational level and can return to school.

Latest procedures for re-study application for secondary school students

Accordind to Article 6 of the Regulation on school change and admittance of pupils to learn at junior and senior secondary schools issued together with Decision 51/2002/QD-BGDDT, dossiers and procedures for re-study application are prescribed as follows:

(1) Dossiers of re-study application

- The re-study application, signed by the pupil concerned.

- The study result register of the grade or educational level already completed (the original).

- The diploma of the lower educational level (a notarized copy).

- The written certification by the administration of the pupils' residence place of his/her observance of the State's policies and laws.

(2) Re-study application procedures

- Cases of application for re-study at former schools:

The principals of the schools shall permit the pupils to study at their schools after checking their dossiers.

- Cases of application for re-study at other schools:

The dossiers shall be supplemented and procedures be carried out as for pupils changing schools.

- Cases of application for re-study at the first grade of the senior secondary education level:

The directors of provincial-level Education and Training Services shall consider and make decisions on the basis of the entrance examination or enrollment consideration results of the pupils before they drop out.

(3) The re-study application shall be effected during the summer vocation time before the start of the new school year.

 

Furthermore, according to Clause 1 Article 28 of the Education Law 2019 of Vietnam, which regulates educational levels and ages for general education, if re-admitted within the age limits for each educational level, the student can continue their education.

If the age exceeds the limit, re-admission is not possible due to the age limit for the educational level (Clause 2 Article 4 of the Regulation on school change and admittance of pupils to learn at junior and senior secondary schools issued together with Decision 51/2002/QD-BGDDT stipulates that re-admission applies to students requesting re-admission after a break but still within the age limits for each educational level).

What responsibilities must lower secondary school students adhere to when returning to school?

Upon returning to the school environment, secondary school students must strictly comply with the responsibilities of students as stipulated in Article 34 of the lower secondary school, upper secondary school and multi-level school charter issued together with Circular 32/2020/TT-BGDDT as follows:

- Learn and train according to curricula and education plans of their schools.

- Respect their parents, officials, teachers and staff of their schools, and those older than them; maintain solidarity and mutual support in learning and training; conform to the charter and rules of their schools; and abide by the law.

- Take exercises and maintain personal hygiene.

- Participate in group activities of their schools and classes, Ho Chi Minh Young Pioneer Organization and Ho Chi Minh Communist Youth Union; help their families, join physical and social activities and environmental protection activities, and maintain traffic order and safety.

- Protect school and public property; contribute to fostering, preservation and enhancement of school traditions.
