Is the period of suspension from work included in the seniority allowance for teachers in Vietnam?

Based on Article 3 of Decree 77/2021/ND-CP:

Periods included and not included in seniority allowance

1. Periods included in seniority allowance

The periods included in seniority allowance are determined by totaling the following periods:

a) Periods of teaching and educating with compulsory social insurance contributions in public educational institutions.

b) Periods of teaching and educating with compulsory social insurance contributions in non-public educational institutions (for teachers currently teaching and educating in public educational institutions who have previously taught or educated in non-public educational institutions).

c) Periods of service included in seniority allowance, including: periods of service ranked by salary in one of the grades or titles of the customs, courts, procuracies, audits, inspections, civil judgment enforcement, rangers, national reserves, party checks; periods of service included in seniority allowance in the army, police, cipher organizations, and periods of service included in seniority in other sectors and professions (if any).

d) Periods of military service as stipulated by law during which the individual was previously entitled to professional seniority allowance.

2. Periods not included in seniority allowance

a) Internship periods.

b) Periods of unpaid leave of one month or more.

c) Periods of sick or maternity leave exceeding the time limits stipulated by social insurance laws.

d) Periods of expert delegation, study, internship, work, or survey in Vietnam and abroad exceeding the time limits decided by competent authorities.

dd) Periods of suspension of work or detention for investigation, prosecution, and trial.

e) Other periods not working beyond the stipulations of points a, b, c, d, dd of clause 2 of this Article.

The suspension period will not be included in teacher seniority allowance.

Who is eligible for the teacher seniority allowance in Vietnam?

According to Article 2 of Decree 77/2021/ND-CP, those eligible for teacher seniority allowance include teachers currently teaching and educating in public educational institutions and academies, schools, and centers responsible for training and fostering under state agencies, political organizations, political-social organizations (hereinafter collectively referred to as public educational institutions), including:

- Teachers include public employees of the education and training sector (with codes starting with V.07) and public employees of the vocational education sector (with codes starting with V.09) listed on payrolls approved by competent authorities, currently teaching and educating in public educational institutions funded by the state (including revenues from the state budget and self-generated revenues as per legal regulations).

- Teachers listed on payrolls approved by competent authorities, currently teaching, guiding practice, conducting experiments on training ships, school workshops, stations, farms, practice centers, laboratories, and subject rooms of public general education institutions, continuing education institutions, vocational education institutions, and public higher education institutions.

Note: Those not in the aforementioned categories but holding codes starting with V.07 and V.09 are not eligible for the teacher seniority allowance.

What are funding sources for seniority allowance policies for teachers in Vietnam?

Based on Article 5 of Decree 77/2021/ND-CP, the source of funding for seniority allowance policies for teachers is from the lawful revenues of the unit and the budget provided by the state, specifically:

- For public educational institutions self-financing regular and investment expenditures and public educational institutions self-financing regular expenditures: The funding for seniority allowance policies is guaranteed from the unit's revenue.

- For public educational institutions partially covering their own recurrent expenditures: The funding for seniority allowance policies is guaranteed from the unit’s revenue and the budget allocated by the state according to the current state budget management decentralization.

- For public educational institutions financed entirely by the state for regular expenditures: The funding for seniority allowance policies is guaranteed by the state budget and allocated in the annual budget estimates of the educational institutions according to the current state budget management decentralization.

In the case of adjustments to the statutory pay rate, ministries, central agencies, and provinces and cities directly under the central government are responsible for organizing, guiding, approving, and summarizing the demands and sources of funding for implementing teacher seniority allowance policies into the demand for wage reform according to current regulations on determining the demand, sources of funding for annual statutory pay rate adjustments; and sending the Ministry of Finance for consideration and approval as per regulations.
