* Note: When determining shortage or surplus of teaching hours (for calculating overtime pay), it will be based on the annual teaching hours benchmark.
This benchmark will be based on the regular teaching hours (standard teaching hours)/week] x (Number of weeks allocated for teaching and educational activities/academic year).

What are the principles for calculating overtime pay for the principal of a secondary school in Vietnam?
Since the principal of a secondary school still receives overtime pay like a regular teacher, the principles for calculating this pay follow Article 3 of Joint Circular 07/2013/TTLT-BGDDT-BNV-BTC, as stated below:
Principle 1. The monthly salary used as a basis for calculating overtime pay for educators includes: the current salary according to their rank and grade, salary allowances, and the reservation coefficient difference (if any).
Principle 2. The annual teaching hour standard for preschool teachers; the annual teaching period standard for general education teachers; the annual teaching hour standard for vocational school teachers;
The annual teaching hour standard for vocational teachers and lecturers; the annual standard teaching hour for university lecturers, training institutions under ministries, governmental agencies, and provincial political schools is referred to as the annual teaching hour standard.
Principle 3. The academic year defined in this circular is from July of the previous year until the end of June of the following year.
Principle 4. For educators working at public educational institutions with multiple education levels, the annual teaching hour standard applies to the highest level the educator directly teaches as assigned by the head of the educational institution.
Principle 5. Budgeting, payment, and finalization of overtime pay funds are implemented following the provisions of the State Budget Law 2015.
Public educational institutions stipulated in Clause 1, Article 1 of Joint Circular 07/2013/TTLT-BGDDT-BNV-BTC, based on specific conditions, to implement payment or provisionally paying overtime salary on a monthly or semester basis appropriately.
Principle 6. Overtime salary is only paid if the unit or subject area lacks an adequate number of educators as approved by competent authorities.
If there is no shortage of educators, overtime salary is paid only when there are educators taking sick leave, maternity leave as prescribed by the Social Insurance Law 2014, or participating in training courses, inspections, audits and other assigned tasks (referred to as other tasks) by competent authorities requiring other educators to take their place.
Principle 7. Time not directly teaching but counted as sufficient teaching hours and credited to teaching hours includes: sick leave, maternity leave as prescribed by the Social Insurance Law 2014; time spent on other tasks assigned by competent authorities.
Principle 8. The number of overtime teaching hours eligible for overtime pay as per Joint Circular 07/2013/TTLT-BGDDT-BNV-BTC should not exceed the legally stipulated overtime hours.
