What are the rights of students in Vietnam?
For Primary school students
According to Article 35 of the Regulation on Primary Schools issued together with Circular 28/2020/TT-BGDDT, primary school students have the following rights:
- Right to learn
+ To be educated and trained to develop comprehensively and to optimize their potential; to study at a school or class that implements the primary education curriculum convenient to their residential area.
+ Students have the right to choose their school or transfer to another school outside their residential area if the school can accept them.
+ Students of primary school age returning from abroad, children of foreigners studying and working in Vietnam, or children in difficult circumstances not able to attend school can request to study at a primary school where the principal will assess and place them in an appropriate class.
+ Students with disabilities are entitled to inclusive education at a primary school and to necessary conditions for learning and training; and are evaluated based on an individual education plan.
+ Students can briefer the duration of the program, study at a higher age than prescribed, prolong the duration, or repeat a grade.
+ Students with good physical strength and early intellectual development can advance a grade within the school level. Specific procedures are as follows:
++ Parents or guardians of students must submit a request to the school.
++ The school principal establishes a survey and consultation council, consisting of: the principal or vice-principal, the parents' representative board, the current class teacher, teachers of the next grade, the medical staff, and the Team Leader.
++ Based on the council’s survey results, the principal finalizes the application and reports to the Head of the Department of Education and Training for consideration and decision.
+ Students with limited academic performance, who have been directly assisted by teachers, parents, or guardians, but still do not meet the requirements may, depending on the level of incompletion, be allowed to proceed to the next grade or repeat by decision of the principal in cooperation with the family to determine appropriate educational measures.
- Right to Protection and Care, Respect, Equal and Democratic Treatment; to ensure legitimate rights and interests; to receive complete information about their learning and training process; to be ensured conditions for learning and training in terms of time, facilities, hygiene, and safety.
- Right to Participate in Activities that Develop Personal Abilities; to express personal opinions and desires.
- Right to Receive Scholarships and Enjoy Social Policies as regulated.
- Right to Other Rights as prescribed by law.
For lower and upper secondary school students
The rights of lower and upper secondary school students in Vietnam are specified in Article 35 of the Regulation issued together with Circular 32/2020/TT-BGDDT:
- Receive comprehensive education with fairness, be provided with time, facilities, hygiene and safety to learn in class and self-learn at home, be informed of their education and training, and be able to use learning, cultural and sport equipment of their schools as per the law.
- Receive respect, protection and fair and democratic treatment, complain to their schools and education authorities about decisions concerning themselves; transfer school with legitimate reason as per existing regulations; enter school before the compulsory starting age, skip a grade and study at an age higher than the compulsory attendance age according to regulations in Article 33 of Circular 32/2020/TT-BGDDT.
- Participate in activities for development of their gifts in academic subjects, sports and art organized by their schools if able to.
- Students eligible for social benefits, disadvantaged students and gifted students may receive sponsorship or other benefits as per the law.
- Transfer school if eligible according to regulations following school transfer procedures stipulated by the Minister of Education and Training.
- Enjoy other rights as per the law.
