Regarding this matter, LawNet would like to answer as follows: 

1. Remuneration regime for participating in the Lottery Supervisory Council in Vietnam

The remuneration regime for participating in the Lottery Supervisory Council is stated in Article 8 of Circular 22/2021/TT-BTC as follows:

- Representatives of agencies participating in the Lottery Supervisory Council, assisting teams or departments of the Lottery Supervisory Council, or the Lottery Supervisory Board (excluding representatives of the Lottery Company) are entitled to remuneration as stipulated in Decree 122/2017/ND-CP on specific provisions on financial management mechanisms and effectiveness evaluation for lottery businesses; the Stock Exchange and Vietnam Securities Depository Center; and related amended or replaced documents (if any).

- Based on the proposal of the Lottery Company, the Department of Finance shall develop and submit to the provincial People's Committee for approval a remuneration level that ensures principles of thriftiness, effectiveness, and is appropriate to the content of the assigned tasks, promoting the responsibility of members in performing supervisory duties.

2. Members of the Lottery Supervisory Council in Vietnam 

Members of the Lottery Supervisory Council are defined in Article 7 of Circular 22/2021/TT-BTC as follows:

- Duties of members of the Lottery Supervisory Council:

+ Being responsible to the Chairman and Vice Chairman of the Lottery Supervisory Council for the implementation of tasks and powers of the Lottery Supervisory Council according to the provisions of this Circular and the operating regulations of the Lottery Supervisory Council;

+ Complying with the legal provisions during the performance of tasks assigned or delegated by the Chairman or Vice Chairman of the Lottery Supervisory Council in accordance with the prescribed regime and operating regulations of the Lottery Supervisory Council;

+ Implementing the tasks of the Lottery Supervisory Council according to the assignment or delegation of the Chairman and Vice Chairman of the Lottery Supervisory Council as stipulated in Circular 22/2021/TT-BTC and the operating regulations of the Lottery Supervisory Council.

- Powers of members of the Lottery Supervisory Council:

+ Requesting the Lottery Company to comply with the legal provisions and operating regulations of the Lottery Supervisory Council;

+ Having the right to express personal opinions on issues related to monitoring results and lottery drawing results;

+ Exercising other powers as stipulated in Circular 22/2021/TT-BTC and the operating regulations of the Lottery Supervisory Council.

3. Operating mechanism of the Lottery Supervisory Council in Vietnam 

The operating mechanism of the Lottery Supervisory Council is defined in Article 4 of Circular 22/2021/TT-BTC as follows:

- The supervision and inspection activities of the Lottery Supervisory Council are based on the legal provisions on lottery business, the operating regulations of the Lottery Supervisory Council, and the business procedures of the Lottery Company.

- The Lottery Supervisory Council operates according to the principles of democracy and majority voting, specifically as follows:

+ The supervision and inspection activities of the Lottery Supervisory Council regarding the tasks specified in Clauses 1, 2, 3, and 4 of Article 9 of Circular 22/2021/TT-BTC must have at least the presence of the Chairman or one Vice Chairman of the Lottery Supervisory Council; the Secretary of the Lottery Supervisory Council; and three members of the Lottery Supervisory Council attending (in case the assisting team or department is delegated by the Lottery Supervisory Council, they must also ensure compliance with the regulations).

+ The organization of meetings of the Lottery Supervisory Council requires the presence of the required members according to the regulations specified in the operating regulations of the Lottery Supervisory Council issued by the provincial People's Committee.

+ The content of meetings, supervision activities, and inspections of the Lottery Supervisory Council must be recorded in minutes and have the full signatures of the attending members. Issues that have different opinions shall be decided or approved when more than 50% of the attending members of the Lottery Supervisory Council agree.

In cases where the number of members who agree and disagree is equal, the decision shall be made based on the agreement of the Chairman of the Lottery Supervisory Council (or the Vice Chairman of the Lottery Supervisory Council if the Chairman is absent).

- The Lottery Supervisory Council operates on a part-time basis, except for the representative of the Lottery Company.
