Regarding this matter, LawNet would like to answer as follows:
Article 16 of the Regulations on the Management of Training and Refresher Courses issued together with Decision 1038/QD-BKHCN in 2019 by the Ministry of Science and Technology stipulates the basis for appointing officials and public employees for refresher courses in Vietnam as follows:
- The selection and appointment of officials and public employees for refresher courses is based on the annual training and development plans of the unit and the Ministry of Science and Technology, as well as the allocated targets and ratios (if any) and the wishes of the officials and public employees.
- In cases where the number of officials and public employees registering for refresher courses exceeds the training targets, the selection and appointment of officials and public employees will be prioritized in the following order:
+ Officials and public employees in priority training areas within the field of expertise of the unit and the Ministry of Science and Technology;
+ Officials and public employees who have been planned by the leadership;
+ Officials and public employees who have been on rotation or have special assignments;
+ Officials and public employees with higher work performance;
+ Female officials and public employees;
+ Officials and public employees who have served longer in the unit;
+ Officials and public employees who have been appointed for training fewer times;
+ Younger officials and public employees with excellent work performance;
+ Officials and public employees who are older in age;
+ Officials and public employees from ethnic minorities.
Article 17 of the Regulations on the Management of Training and Refresher courses issued together with Decision 1038/QD-BKHCN in 2019 by the Ministry of Science and Technology stipulates the procedures for selecting and appointing officials and public employees for refresher courses in Vietnam as follows:
- For training programs included in the Ministry's plan and allocated targets by other agencies:
+ The Personnel Organization Department announces the training courses.
Based on the content and requirements of the training course, the Personnel Organization Department sends written notifications to relevant units to propose the selection of officials to attend.
+ Units register candidates for selection.
Based on the allocated targets and the conditions and criteria of the training course, the heads of units responsible for managing and utilizing officials and public employees notify the officials in their unit and subordinate units (if any) to register their needs and select suitable candidates. They then send written introductions of the candidates to the Personnel Organization Department within the specified timeframe.
+ The Personnel Organization Department submits a decision to the Ministry's leadership for appointing officials for training.
Based on the allocated targets and the number of candidates introduced by the units, the Personnel Organization Department reviews, consolidates, and reports to the Ministry's leadership for consideration and decision.
Within 3 working days from the date the Ministry's leadership provides guidance and opinions, the Personnel Organization Department sends a written notification of the results of the selection and appointment of officials for training to the unit responsible for managing and utilizing the officials and public employees. The officials and public employees selected for training are responsible for completing and submitting the required application documents according to the requirements of the Personnel Organization Department.
+ For special cases where it is necessary to designate specific officials to attend the training course to meet the mission requirements of the agency, the Personnel Organization Department's leadership exchanges and reaches an agreement with the relevant unit's leadership before submitting it to the Ministry's leadership for consideration and decision.
- For cases where units or individuals independently contact the training targets:
+ The head of the agency with the authority to manage officials shall, based on the provisions of Article 13 of the Regulations on the Management of Training and Development Activities issued together with Decision 1038/QD-BKHCN in 2019 by the Ministry of Science and Technology and other provisions in the Regulations on the Management of Training and Development Activities, consider and decide on appointing (or not appointing) officials and public employees for training.
+ Officials who register for training must prepare their application documents, including:
++ Admission notice from the training institution (or invitation letter);
++ Application form for training from the official and public employee;
++ Written consent of the head of the unit directly responsible for managing and utilizing the official and public employee;
++ Photocopy of the recruitment decision, appointment decision to the position, or decision on acceptance and assignment of duties for the official and public employee;
++ Presentation on the research and study content for long-term training (over 3 months) and other required documents for each training course.
