Modifying the process of renaming villages and residential groups in Vietnam

On May 23, 2022, the Minister of Home Affairs of Vietnam issued Circular 05/2022/TT-BNV amending Circular 04/2012/TT-BNV guiding the organization and operation of villages and residential groups. in Vietnam, which amends the process of renaming villages and residential groups in Vietnam.

Accordingly, the renaming of villages and residential groups in Vietnam follows the following steps:

- The commune-level People's Committee in Vietnam shall make a dossier, including:

+ The report;

+ The plan to change the name of the village or residential group (the plan should clearly state the reason for the change of the name of the village or residential group; the name of the village or residential group after the name change).

- Then organize to collect opinions of all voters or voters representing households in villages and neighborhood groups on the plan to rename villages and residential groups in Vietnam, synthesize opinions and formulate into a minutes to collect opinions:

+ If the plan to change the name of a village or residential group is approved by more than 50% of the voters or the electorate representing the household, the commune-level People's Committee shall complete the dossier and submit it to the People's Council of the same level for approval. renaming villages and residential quarters; within five working days from the date of issuance of the resolution of the commune-level People's Council, the commune-level People's Committee shall complete the dossier and submit it to the district-level People's Committee.

Where there is no commune-level People's Council, within ten working days from the date of collection of opinions from voters or electors representing households, the commune-level People's Committee shall complete the dossier and submit it to the People's Committee of the commune. + If the plan for renaming villages or residential groups has not been approved by more than 50% of the electorate or the electors representing households, the commune-level People's Committees shall organize a second opinion gathering; if still not approved by more than 50% of the electors or the electors representing households, within five working days from the date of the second written opinion collection, the commune-level People's Committees shall report to the commune-level People's Committees. district-level People's Committees to consider and decide (New content added).

- Within ten working days from the date of receipt of complete and valid dossiers transferred by the People's Committees of communes of Vietnam, the People's Committees of districts of Vietnam shall submit a statement enclosed with the dossiers to the Department of Home Affairs of Vietnam. expertise;

- Within ten working days from the date of receipt of complete and valid dossiers transferred by the district-level People's Committees, the Department of Home Affairs of Vietnam shall appraise and report to the provincial-level People's Committees for submission to the provincial-level People's Councils. consider promulgating a Resolution on renaming villages and residential quarters.

Circular 05/2022/TT-BNV takes effect from the date of signing and promulgation.
