Guidance on making a list for employees to receive support due to Covid-19 in accordance with regulations of the Vietnam Social Security

1. Support for employees on suspension of employment contracts and unpaid leave (form No. 01) prescribed in Section II of the Official Dispatch No. 2209/UBND-KT

- Employees have period of suspension of employment contracts or unpaid leave within the term of the employment contracts is from 30 consecutive days or more from May 1, 2021 to the end of December 31, 2021, with a start date of suspension of employment contracts or unpaid leave between May 1, 2021 and December 31, 2021; have contributed to compulsory social insurance up to the month preceding the time of suspension of employment contracts or unpaid leave.

- Employers make 02 copies of list (form No. 01) then send to the Social Security of Thu Duc city or districts where the unit resides (not based on the Social Security agencies where it is being managed) by post, and at the same time send the data file (form No. 01) to the collection management (the Social Security agencies where it is being managed) via zalo or email for confirmation.

- When the Social Security agency confirms form No. 01, the ineligible cases will be notified via email (or text message) for the employer to review and make additional declaration in the next batch (if any).

2. Support for workers subject to termination of employment contract but ineligible for unemployment benefit (form No. 02) prescribed in Section III of the Official Dispatch No. 2209/UBND-KT

- Employee whose employment contract is terminated in the period from May 1, 2021 to December 30, 2021 inclusive but they are ineligible for unemployment benefit, except for the following cases:

+ The employee unilaterally terminates the employment contract against the law.

+ The employee is on monthly pension or work-capacity loss allowance.

- After carrying out the procedures for notification of reduction and confirmation of social insurance books, employers will guide employees (not eligible for support specified in Section II of the Official Dispatch No. 2209/UBND-KT) to make a request for support (form No. 02) and submit together with relevant documents to the social insurance agency of Thu Duc city or district (where the employee lives) by post during the time of social distancing.

Sau khi thực hiện thủ tục báo giảm, xác nhận sổ BHXH, người sử dụng lao động hướng dẫn cho người lao động (không thuộc diện hỗ trợ quy định tại Mục II Công văn 2209/UBND-KT) lập giấy đề nghị hỗ trợ (Mẫu số 2) nộp kèm hồ sơ liên quan cho BHXH thành phố Thủ Đức, quận, huyện (nơi người lao động sinh sống) qua bưu điện trong thời gian giãn cách xã hội.
