Vietnam: Responsibilities of construction owners in construction maintenance

According to Circular No. 26/2016/TT-BXD of the Ministry of Construction of Vietnam on the elaboration of a number of aspects of construction quality control and maintenance, responsibilities for construction maintenance are prescribed as follows:

- For the construction works owned by sole proprietor:

+ The entities designated to manage and operate the State-owned construction works shall be responsible for the maintenance of such construction works.

+ The investors of the construction works other than state-own construction works shall be responsible for the maintenance of their construction works.

The investor shall be responsible for the maintenance of urban infrastructures until it is transferred to the State authority.

- For construction works owned by multiple proprietors:

+ For housing, occupiers shall be responsible for the maintenance of their own apartments and agree to participate in the maintenance of shared areas;

+ For other construction works, the owner of parts of the construction works shall be responsible for the maintenance of their own parts and shared areas of the construction works.
