Vietnam’s regulation on issuance of bidding operation certificates

According to the Circular, guidelines on the issuance of bidding operation certificates are as follows:

(1) Bidding operation certificates shall be issued to the following individuals:

- Individuals participating in expert teams and appraising teams in bidding for contractor selection as prescribed in Article 19 of the Law on Bidding and Article 19 of Decree No. 24/2024/ND-CP.

- Individuals participating in expert teams and appraising teams in bidding for investor selection for investment projects prescribed in Clause 3 Article 1 of Decree No. 23/2024/ND-CP on elaboration on and measures for the implementation of the Law on Bidding on the selection of investors to implement projects subject to bidding organization according to special laws;

- Individuals participating in expert teams in bidding for investor selection for public-private partnership investment projects as prescribed in Article 33 of Decree No. 35/2021/ND-CP.

(2) A bidding operation certificate shall be issued in one of the following cases:

- First-time issuance of the certificate when the following conditions are met: having adequate legal capacity, not being subject to criminal prosecution; passing the bidding operation examination according to Circular No. 02/2024/TT-BKHDT;

- Certificate re-issuance shall only be implemented if the issued bidding operation certificate is lost or damaged or contains incorrect information; 

- Bidding operation certificate renewal shall only be implemented in case the certificate expires according to Clause 1 Article 8 of Circular No. 02/2024/TT-BKHDT. Individuals shall apply for certificate renewal on the System within 15 days from the expiry date of their certificates.  After the prescribed time, individuals may not apply for certificate renewal. If they wish to have the certificates, they must take the examination for first-time issuance as prescribed in Point a Clause 2 Article 7 of Circular No. 02/2024/TT-BKHDT.
