Vietnam: Infringing on industrial property rights shall be fined up to VND 30 million

This content is specified in the Joint Circular No. 05/2016/TTLT-BKHCN-BKHĐT of the Minister of Science and Technology and the Minister of Planning and Investment of Vietnam detailing and guiding measures against corporate names that infringe industrial property rights.

Any business that uses a business name that infringes on industrial property rights may be handled as follows:

- A fine of up to VND 30,000,000 shall be imposed for acts of infringing rights to trademarks and trade names as prescribed in Decree No. 99/2013/ND-CP of Vietnam’s Government.

- Forcible alteration of enterprise names, removal of infringing elements in enterprise names.

- Revoke the Certificate of Business Registration when not changing the business name or forcing the removal of infringing elements in the business name or not submitting an explanation report etc.

Agencies and persons have the authority to sanction this act according to the provisions of Chapter III Decree No. 99/2013/ND-CP.

Joint Circular No. 05/2016/TTLT-BKHCN-BKHĐT takes effect from May 20, 2016.
