Vietnam: Guiding the reception, treatment and management of persons complying with compulsory medical treatment measures

Recently, the Ministry of Health of Vietnam has issued the Decision No. 5091/QĐ-BYT on the provisional promulgation of the Process of receiving, treating and managing persons complying with the judicial measure of compulsory medical treatment.

According to the Decision No. 5091/QĐ-BYT of the Ministry of Health of Vietnam, a dossier of receipt of a person subject to the judicial measure of compulsory medical treatment includes the documents specified in Clause 2 Article 136 of the Law on Execution of Criminal Judgments 2019 of Vietnam, specifically:

- A decision of a procuracy or court to apply the measure of compulsory medical treatment (the original);

- Conclusion of a medical examination council (copy);

- Resume of the person subject to compulsory medical treatment (the original or copy);

- Other relevant documents: A document recording the assessment process of the Forensic Psychiatric Examination Council (copy), each stage of the proceedings with appropriate documents such as: Decision on temporary suspension, Decision on suspension, Litigation decision, etc.;

Moreover, the person subject to compulsory medical treatment must provide four (04) latest 4x6 photos within 6 months.
