On June 28, 2024, the 15th National Assembly of the Socialist Republic of Vietnam approved the Capital Law 2024 at the 7th meeting.
Specifically, the Capital Law 2024 provides for the position and role of the Capital; policies on and responsibilities for Capital construction, development, management, and protection.
According to the Law, the Capital of the Socialist Republic of Vietnam is Hanoi.
Regarding the application of the Capital Law 2024:
(i) In case of discrepancies between the Capital Law 2024 and other laws and resolutions of the National Assembly of Vietnam regarding the same matter, the Capital Law 2024 shall prevail, excluding cases prescribed in (ii).
(ii) Where laws and resolutions of the National Assembly of Vietnam promulgated after the effective date of the Capital Law 2024 stipulates any regulation on the same matter different from the Capital Law 2024 that requires application, the application date shall be specified in such laws and resolutions; in case specific regulations on the application of laws are unavailable and such an application is necessary for the construction, development, management, and protection of the Capital, the Standing Committee of the National Assembly of Vietnam shall decide on the application at the request of the Government of Vietnam and submit reports to the National Assembly of Vietnam at the nearest meeting.
(iii) Legislative documents elaborating on the Capital Law 2024 and legislative documents promulgated for the implementation of jurisdiction assigned in the Capital Law 2024 shall be applied in cases where many legislative documents stipulate the same matter differently.
See more details in the Capital Law 2024, effective as of January 1, 2025, excluding the following regulations, which take effect from July 1, 2025;
- The management and use of underground space prescribed in Article 19 of the Capital Law 2024;
- The establishment of areas for commercial and cultural development prescribed in Clause 7 Article 21 of the Capital Law 2024;
- The scientific and technological development, creative innovation, and digital transformation prescribed in Article 23 of the Capital Law 2024;
- The controlled testing prescribed in Article 25 of the Capital Law 2024;
- The implementation of build-transfer contract prescribed in Article 40 of the Capital Law 2024.
The Capital Law 2012, Resolution No. 97/2019/QH14, Resolution No. 160/2021/QH14, and Resolution No. 115/2020/QH14 shall be annulled from January 1, 2025.
