On November 1, 2024, the Office of the Government of Vietnam issued Notification 501/TB-VPCP on the conclusions of Deputy Prime Minister Tran Hong Ha at the meeting reviewing the draft Decree guiding the Road Law in 2024 and the Law on Road Traffic Order and Safety in 2024.
Regarding the draft Decree detailing and providing measures to implement the Law on Road Traffic Order and Safety in 2024, the Ministry of Public Security of Vietnam is requested to:
- Focus on thoroughly reviewing regulatory contents on ensuring traffic order and safety for the vulnerable participants in road traffic such as students, the elderly, and individuals with disabilities; pay attention to supplement contents that stipulate the responsibilities of families, schools, and educational institutions in managing students using motorcycles in traffic in accordance with the law.
- Review and supplement the regulatory contents regarding the database on traffic order and safety, ensuring completeness and synchronization with other functional agencies to serve the management and operation of transport and traffic order and safety, convenient for residents and businesses to search and perform.
- Supplement the regulatory contents on promoting the application of science and technology in managing and operating traffic, aiming to reduce activities of direct patrolling, controlling, and violation handling; further clarify the legal and practical basis for the scope and subjects required to license smart traffic vehicles as per the appraisal opinion of the Ministry of Justice (The Ministry of Public Security and the Ministry of Transport of Vietnam should study the experiences of other countries in managing smart traffic vehicles to complete the legal framework, meeting management demands).
- Consider separating the contents regarding the Fund for Minimizing Damage Caused by Road Traffic Accidents (Chapter VII of the draft Decree) into a separate Decree as conformable to clause 5, Article 85 of the Law on Road Traffic Order and Safety in 2024. Assign the Ministry of Public Security to preside, in cooperation with the Ministries of Finance, Justice, Transport, and related agencies, to draft the Decree and submit it to the Government of Vietnam before June 30, 2025.
