Regulations on Submission, Appraisal, and Approval of Plans for Selecting Drug Suppliers

The Minister of Health promulgates Circular 07/2024/TT-BYT dated May 17, 2024, stipulating the bidding procedures for pharmaceuticals at public healthcare institutions.

Regulations on Submission, Appraisal, and Approval of Drug Supply Contractor Selection Plan

Submission, appraisal, and approval of the drug supply contractor selection plan are as follows:

- The submission document for the drug supply contractor selection plan shall follow the template specified in Appendix II issued with Circular 07/2024/TT-BYT.

In cases where the form of open bidding is not applied, the submission document must clearly state the reasons for proposing the application of a different contractor selection method for the competent authority to consider and decide.

- The appraisal of the contractor selection plan shall be conducted in accordance with the regulations in Article 128 of Decree 24/2024/ND-CP. The appraisal report is prepared following the template specified in Appendix III issued with Circular 07/2024/TT-BYT.

- Approval of the contractor selection plan shall be in accordance with the regulations in Articles 40 and 41 of the Bidding Law 2023.

- For procurement cases specified in Clause 3, Article 3 of Circular 07/2024/TT-BYT, the head of the unit being the focal point for procurement or the unit assigned with the procurement task shall organize the appraisal and approval of the contractor selection plan.

Forms and Methods of Selecting Drug Supply Contractors

The forms and methods of selecting drug supply contractors are as follows:

- Forms of contractor selection: Based on the price and nature of each package, one of the following contractor selection forms shall be chosen: open bidding, limited bidding, direct appointment, competitive offer, direct purchase, online quotation, online purchase;

- Methods of contractor selection: The one-stage one-envelope method shall be applied according to the regulations in Article 30 of the Bidding Law 2023. Public healthcare units shall only apply the one-stage two-envelope method when there are specific legal guidelines regarding science and technology.
