Cases for grouping of apartment buildings for renovation in Vietnam from August 1, 2024

The cases for the grouping of apartment buildings for renovation are as follows:

- Grouping several independent apartment buildings within the same ward into one or two locations with apartment buildings subject to grouping within that ward.

- If the grouping within the same ward cannot be conducted according to the provisions of Clause 1, Article 37 of Decree 98/2024/ND-CP, then collect several apartment buildings in adjacent wards within the same district.

- If the grouping within the same district cannot be conducted according to the provisions of Clause 2, Article 37 of Decree 98/2024/ND-CP, then collect several apartment buildings in adjacent districts.

- If the grouping according to the provisions of Clauses 1, 2, or 3, Article 37 of Decree 98/2024/ND-CP cannot be implemented, the Provincial People's Committee shall advance funds from the local regular expenditure budget for relocation, compensation, support, and resettlement for owners and users of these apartment buildings and organize the auction of the apartment land to repay the state budget. The investment in construction works on auctioned land is implemented according to the approved planning.

If according to the approved planning, the apartment land subject to grouping is allocated for public works, compensation, clearance, demolition, and land recovery will be done by land law regulations to implement the planning.

More details can be found in Decree 98/2024/ND-CP, which takes effect from August 1, 2024.

Decree 69/2021/ND-CP on renovation and reconstruction of apartment buildings in Vietnam will cease to be effective from the date Decree 98/2024/ND-CP takes effect in Vietnam.
