Procedure for Re-issuance of Permit for Transporting Dangerous Goods Due to Loss or Damage Effective from May 15, 2024The procedure for re-issuance of the permit for transporting dangerous goods due to loss or damage, effective from May 15, 2024, is content issued by the Ministry of Transport under Decision 421/QD-BGTVT. This decision announces new administrative procedures in the field of transportation under the management scope of the Ministry of Transport.

Procedure for Reissuing Permits for the Transportation of Hazardous Goods Due to Loss or Damage from May 15, 2024

The procedure for reissuing permits for the transportation of hazardous goods due to loss or damage is as follows:

* Submission of administrative procedure documents:

Individuals or organizations transporting hazardous goods shall submit documents to the agency issuing the permit for the transportation of hazardous goods, specifically:

- The Ministry of Public Security issues permits for the transportation of hazardous goods classified as type 1, type 2, type 3, type 4, and type 9 according to the regulations in Clause 1, Article 4 of Decree 30/2024/TT-BGTVT (excluding pesticides and organizations, enterprises under the management scope of the Ministry of National Defense).

- The Ministry of National Defense issues permits for the transportation of hazardous goods to organizations and enterprises under the management scope of the Ministry of National Defense.

- The Ministry of Science and Technology issues permits for the transportation of hazardous goods classified as type 5 and type 8 according to the regulations in Clause 1, Article 4 of Decree 30/2024/TT-BGTVT.

- Provincial and municipal People's Committees issue permits for the transportation of hazardous goods that are pesticides.

* Resolution of administrative procedures:

- In case of direct submission: The administrative procedure-resolving agency shall check the document components and respond immediately when the organization or individual submits the documents; if the document components are incomplete or incorrect, guidance shall be given to complete the documents according to the regulations.

In case of submission via postal service or online public service system: Within no more than 01 business day from the date of receiving the documents, the administrative procedure-resolving agency shall review the completeness; if the documents are incomplete according to the regulations, the administrative procedure-resolving agency shall notify in writing or through the online public service system for the organization or individual to supplement, while guiding the completion of the documents in accordance with regulations;

- Within 02 business days from the date of receiving the complete documents according to the regulations, the permit-issuing agency shall appraise the documents and issue the permit for the transportation of hazardous goods. If the permit is not issued, the permit-issuing agency must respond in writing or notify through the online public service system and clearly state the reason.
