Personnel work for social insurance agencies subject to merger and reorganization in districts in Vietnam

On August 30, 2024, the Vietnam Social Security issued Official Dispatch 2977/BHXH-TCCB providing guidance on the organization, personnel arrangement, and the handover of tasks, finances, and assets for merged units in accordance with the Resolution of the Standing Committee of the National Assembly.

Personnel work for social insurance agencies subject to merger and reorganization in districts in Vietnam

According to Clause 2, Section III of Official Dispatch 2977/BHXH-TCCB dated August 30, 2024, the personnel work for social insurance agencies subject to merger and reorganization in districts in Vietnam is as follows:

- Appointment, Transfer, and Appointment of Managing Public Employee:

+ For managing public employees who are Directors of District Social Security Offices, they may be considered for appointment to an equivalent position or transfer and appointment to a position lower than their current one at the merged or rearranged district social security offices. They may also be considered for transfer and appointment to a managing position at the provincial social security department offices according to the resolution on merging districts into the city, where the provincial social security office is headquartered. The collective leadership and the Party Committee of the provincial social security office will consider, approve by resolution, and present it to the General Director (via the Organization and Personnel Department) for approval without having to follow the regulated human resource procedures; the reappointment period is calculated from the effective date of the previous position appointment decision.

+ For managing public employees who are Deputy Directors of District Social Security Offices: The collective leadership and the Party Committee of the provincial social security office will consider, approve by resolution, and make decisions according to decentralization without having to follow the regulated human resource procedures.

+ For managing public employees considered for appointment to a higher position or transferred and appointed to a position at district social security offices or other units outside the merged and rearranged district social security offices, the provincial social security office will follow the procedures as per Vietnam Social Security regulations.

+ In cases where the managing public employee is being considered for appointment, but the remaining working time until retirement is less than 02 years, the appointment will follow the regulations at Point a, Clause 2, Section III of Official Dispatch 2977/BHXH-TCCB dated August 30, 2024.

- Based on the number of Deputy Directors at the merged and rearranged district social security offices, the provincial social security office will arrange and allocate to appropriate units based on each managing public employee's capability and strengths. This ensure: At the latest, within 05 years from the effective date of the National Assembly Standing Committee’s resolution on arranging each administrative unit, the number of leaders, managers, officials, and public employees, and workers in the units after reassignment must comply with the regulations and guidelines of Vietnam Social Security. In special cases, they will be submitted to the General Director for consideration and decision.

- For public employees who do not hold managing positions: The collective leadership and the Party Committee of the provincial social security office will evaluate each public employee's ability and strengths, emphasize enhancing the human resources for district social security offices, reduce intermediate levels, and reduce indirect positions at the provincial social security office. Based on this, they will adopt a resolution for the overall rearrangement at the district social security offices to ensure compactness, increase effectiveness and efficiency, meets the requirements of the district social security offices, commensurate with the capabilities and professional qualifications of the public employees and job requirements.

- Public employees at the merged and rearranged district social security offices will retain their equivalent planned positions that have been approved.
