Delegation of administrative procedures resolution in medical examination and treatment under the management of the Ministry of Health of Vietnam

On December 31, 2024, the Minister of Health of Vietnam promulgated Circular 57/2024/TT-BYT stipulating the delegation of administrative procedure resolution in the field of medical examination and treatment under the management authority of the Ministry of Health.

According to Circular 57/2024/TT-BYT, the administrative procedures in the field of medical examination and treatment have been delegated by the Ministry of Health of Vietnam to each agency based on their functional scope, tasks, and authorities:

- The Department of Medical Examination and Treatment Management is delegated to resolve 12 administrative procedures in the field of medical examination and treatment.

- The Department of Traditional Medicine and Pharmacy Management is delegated to resolve 12 administrative procedures in the field of medical examination and treatment.

- The Department of Environmental Health Management is delegated to resolve 02 administrative procedures in the field of medical examination and treatment.

- The Health Departments of provinces and central-affiliated cities are delegated to resolve 04 administrative procedures in the field of medical examination and treatment.

Refer to detailed content in Circular 57/2024/TT-BYT, effective from March 1, 2025.

For records submitted before Circular 57/2024/TT-BYT becomes effective: The receiving agency continues to resolve according to the current regulations until the conclusion of administrative procedures.

Documents stipulated in Articles 1, 2, 3, and 4 of Circular 57/2024/TT-BYT issued before March 1, 2025, continue to hold legal value. In cases of reissuance, adjustment, extension, or revocation, organizations and individuals shall comply with the provisions of Circular 57/2024/TT-BYT.

Regarding the responsibility for implementation of Circular 57/2024/TT-BYT:

- The Head of the Department of Medical Examination and Treatment Management, the Head of the Department of Traditional Medicine and Pharmacy Management, and the Head of the Department of Environmental Health Management are responsible for:

+ Organizing the implementation of resolving the administrative procedures delegated in Circular 57/2024/TT-BYT according to the legal framework; signing and utilizing the unit's seal to resolve the administrative procedures delegated in Circular 57/2024/TT-BYT, including proposing supplementary documents, returning records and other actions to implement the administrative procedures delegated in Circular 57/2024/TT-BYT;

+ Delegating the Deputy Heads to sign on behalf of administrative procedure resolution documents within their authority when necessary.

- The Director of the Health Department is responsible for:

+ Organizing the implementation of resolving the administrative procedures delegated in Circular 57/2024/TT-BYT accordance with the law;

+ Reporting to the Ministry of Health on the results of resolving the administrative procedures delegated in Circular 57/2024/TT-BYT annually.
