Law on national defense and security industry, and industrial mobilization 2024 which comes into force in Vietnam from July 1, 2025

The application of the Law on national defense and security industry, and industrial mobilization is regulated as follows:

(1) National defense industry, security, and industrial mobilization activities shall be conducted in accordance with the provisions of the Law on national defense and security industry, and industrial mobilization and relevant laws.

(2) In cases where there are different provisions between the Law on national defense and security industry, and industrial mobilization and other laws on the same issue, the provisions of the Law on national defense and security industry, and industrial mobilization shall apply to the following contents:

- Distribution of post-tax profits of enterprises; transfer of budget sources for procurement and production of strategically significant weaponry equipment and specialized technical means;

- Assignment of tasks, ordering the production of defense and security products; forms of contractor selection for packages producing and supplying defense and security products; evaluation councils for Group A projects; forms of investor selection and contractor selection for programs, investment projects, procurement of materials and supplies serving the national defense and security industry with content classified as Top Secret or higher; negotiation and signing of contracts for technology transfer, joint ventures, partnerships with foreign partners;

- Authority to approve and sign contracts for the implementation of national-level scientific and technological tasks; budgeting for contingency expenses for scientific and technological tasks related to the research and manufacture of strategically significant weaponry, specialized technical means;

- Prices for weaponry and technical equipment when applying general pricing methods with specific features; implementation of designating suppliers and applying price negotiations for the procurement of prototypes, specialized materials, and semi-finished products serving defense and security production;

- Exemption from civil liability when conducting scientific, technological, and innovative activities serving the national defense and security industry; provisions on policies and incentives for leading experts, scientists, and chief engineers;

- Regimes and policies for workers in core national defense industry establishments and core security industry establishments.

(3) In cases where other laws enacted after the effective date of the Law on national defense and security industry, and industrial mobilization require specific provisions on the national defense industry, security, and industrial mobilization that differ from those specified in the Law on national defense and security industry, and industrial mobilization, the specific content to be implemented or not should be clearly defined according to the provisions of the Law on national defense and security industry, and industrial mobilization, and the content implemented according to those other laws, excluding the provisions specified in clause (2) above.

The Ordinance on National Defense Industr 2008 has been amended with several articles according to the Ordinance No. 01/2018/UBTVQH14, and the Ordinance on Industrial Mobilization No. 09/2003/PL-UBTVQH1 2003 will be null and void from the date the Law on national defense and security industry, and industrial mobilization 2024 takes effect in Vietnam.
