Full text of Law on Archives 2024 officially available in Vietnam

The Law on Archives 2024 stipulates the management of archival documents and archival document databases; archival operations; archival documents of special value and promoting the value of archival documents; private archives; archival service activities and state management of archives.

The application of Law on Archives 2024 and related laws is as follows:

- The archiving of documents belonging to the National Archives of Vietnam, privately held documents of special value, must comply with the provisions of Law on Archives 2024, except for the cases specified in Clauses 2 and 3, Article 3 of Law on Archives 2024.

- In cases where the archival documents are recognized as national treasures or recognized and registered in other forms according to the provisions of the Cultural Heritage Law 2001 and other relevant laws, in addition to implementing the provisions of Law on Archives 2024, compliance with the provisions of the Cultural Heritage Law 2001 and other relevant laws is required. The export of archival documents recognized as national treasures abroad is decided by the Prime Minister of the Government of Vietnam.

- In cases where other laws have different regulations on the duration of archival and the responsibility for managing archival documents in current archives, the provisions of those laws shall apply.

- The archiving of documents belonging to the Communist Party of Vietnam Archives is carried out according to the regulations of the competent bodies of the Communist Party of Vietnam.

- Organizations, individuals, families, lineages, and communities decide to apply the provisions of Law on Archives 2024 to the archival of private archival documents not falling under the cases specified in Clause 1, Article 3 of Law on Archives 2024.

Principles of archiving in Vietnam according to Law on Archives 2024

- Ensure the leadership of the Communist Party of Vietnam; centralized and unified management of the State; participation of society, agencies, organizations, individuals, families, lineages, and communities.

- Ensure the objective of effectively promoting the value of archival documents for the national and ethnic interests and the legitimate rights and interests of agencies, organizations, and individuals.

- Ensure citizens' right to access information in archival documents according to the provisions of the 2013 Constitution and the law.

- Ensure transparency, publicity, proper authority in accordance with Vietnamese law, and compliance with international standards and practices.

- Manage archival documents according to archival fonds, combining territorial management, ensuring the scientific, systematic, objective, comprehensive, and historical continuity of archival documents.

- Ensure the safety, integrity, and long-term preservation of archival documents and carry out backup archiving of archival documents.

Law on Archives 2011 expires from July 1, 2025, except for the cases specified in Points a, b, c, and d, Clause 1, Clauses 5 and 6, Article 65 of Law on Archives 2024.
