Vietnam’s new regulation on auctioned property from January 1, 2025

The Law on amendments to the Law on Property Auction 2024 amends Article 4 of the Law on Property Auction 2016 on auctioned property as follows: 

Property required by law to be sold through auction includes: 

- Land use rights according to the law on land; 

- Mining rights according to the law on minerals; 

- Rights to use radio frequencies according to the law on radio frequencies; 

- Rights to use telecommunications codes and numbers and Vietnamese domain names “.vn” according to the law on telecommunications; 

- Rights to use and lease forests according to the law on forestry; 

- Fixed assets of enterprises according to the law on management and use of state capital invested in production and business at enterprises; 

- Property being national reserve goods according to the law on national reserves; 

- Public property at agencies, organizations, and units, infrastructure property, property over which ownership by the entire people is established, and property of projects funded by the state budget according to the law on management and use of public property; 

- Property for judgment enforcement according to the law on civil judgment enforcement; 

- Collateral according to the law on obligation implementation assurance; 

- Property distrained to secure the execution of administrative penalty decisions according to the law on administrative handling. 

- Property of cooperatives and cooperative unions subject to bankruptcy according to the law on cooperatives and the law on bankruptcy; 

- Property of enterprises subject to bankruptcy according to the law on bankruptcy; 

- Bad debts and collateral of bad debts of organizations whose charter capital is wholly owned by the State established by the State Bank of Vietnam to handle bad debts of credit institutions as prescribed by the law; 

- Other property to be sold through auction as prescribed by the law. 

Property not prescribed above selected for auction by organizations and individuals.
