Guidance on the Implementation of Joint Obligations in Civil Judgment Enforcement

The Ministry of Justice, in coordination with the Supreme People's Court and the Supreme People's Procuracy, promulgates Joint Circular 11/TTLT-BTP-TANDTC-VKSNDTC stipulating certain issues regarding civil judgment enforcement (THADS) procedures and inter-sectoral coordination in THADS.

The execution of judgments for joint obligations shall be carried out as follows:

- For judgments or decisions of the Court that declare joint obligations but do not specify or clearly determine the obligations of each person, the Enforcement Agency shall require one or several individuals who have the capability to fulfill the entire joint obligation;- Other persons with joint obligations are responsible for reimbursing the portion of the obligation to the individual who has performed the obligation on their behalf;- If the judgment creditor agrees that one or several individuals among those obligated to execute the joint obligation do not fulfill their obligation, the portion of the obligation not required for enforcement shall be suspended in accordance with regulations.

Joint Circular 11/TTLT-BTP-TANDTC-VKSNDTC takes effect from September 30, 2016, replacing Joint Circular 14/2010/TTLT-TANDTC-VKSNDTC.
