Case of Enterprises being Allowed to Pay into the Occupational Accident and Disease Insurance Fund at a Lower Rate

Decree 58/2020/ND-CP stipulates the compulsory social insurance contribution rates to the Occupational Accident and Disease Insurance Fund, issued on May 27, 2020.

According to Decree 58/2020/ND-CP, enterprises operating in industries with high risks of occupational accidents and occupational diseases are allowed to apply the contribution rate of 3% of the salary fund as a basis for compulsory social insurance contributions if the following conditions are met:

- Within the 03 years up to the time of proposal, there have been no administrative violations penalized by fines, and no criminal prosecutions for violations of laws on occupational safety, health, and social insurance;- Periodically reporting occupational accidents and reporting on occupational safety and health accurately, fully, and timely within 03 consecutive years before the proposal year;- The frequency of occupational accidents in the year preceding the proposal year must be reduced by 15% or more compared to the average occupational accident frequency of the 03 consecutive years prior to the proposal year or no occupational accidents occurred within 03 consecutive years prior to the proposal year.
