Regarding this issue, LawNet would like to answer as follows:

1. Order of assessment and grading of cadre quality in Vietnam

According to Article 17 of Decree 90/2020/ND-CP, the order and procedures for assessing and classifying staff quality are carried out according to the following steps:

- Staff self-evaluate and grade quality.

Reporters make self-assessment reports, receive the rating of work results according to their assigned responsibilities and tasks according to Form No. 01 of the Appendix issued together with Decree 90/2020/ND-CP.

- Comments and evaluations of staff:

+ Organize a collective meeting of the leaders of the agency or organization where the cadre works to comment on and evaluate the cadre. Officers present the report on self-assessment of work results at the meeting, and the members attending the meeting give comments. The opinions must be recorded in the minutes and approved at the meeting.

+ The level competent to manage cadres shall decide on the collection of comments and evaluations from agencies, organizations, and units under the leadership and direct management competence of the evaluated cadres.

- Collect comments and assessments from the Party committee at the same level where the cadres work.

- Reviewing, deciding to evaluate, and classifying the quality of staff

The staffing agency of the agency in charge of personnel management synthesizes comments and evaluations according to the provisions of Clauses 2 and 3, Article 17 of Decree 90/2020/ND-CP, and related documents (if any), and proposes assessment contents and quality ratings for officials.

The level competent to manage cadres considers, decides to evaluate, and grades the quality of cadres.

- Announce the results of the evaluation and classification of staff quality.

The level competent to manage cadres shall notify in writing the staff and publicly announce the results of quality assessment and classification in the agency, organization, or unit where the cadre works; decide on the form of publicity in the agency, organization, or unit where the cadre works, in which priority is given to the application of the form of publicity in the electronic environment.

2. Order of assessment and classification of civil servant quality in Vietnam

The order of assessment and classification of civil servant quality in Vietnam according to Article 18 of Decree 90/2020/ND-CP is as follows:

- For civil servants who are heads of agencies, organizations, or units:

+ Civil servants self-evaluate and grade quality.

Civil servants make self-assessment reports, receive the rating of work results according to their assigned responsibilities and tasks according to Form No. 02 of the Appendix issued together with Decree 90/2020/ND-CP.

+ Comments and evaluations of civil servants

Hold a meeting at the agency, organization, or unit where the civil servant works to comment on and evaluate the civil servant.

Participants in the meeting include all civil servants of agencies, organizations, and units.

Where an agency, organization, or unit has a constituent unit, the composition includes the collective leadership of the agency, organization, or unit, representatives of party committees, trade unions, youth unions of the same level, and heads of constituent units; for large-scale agencies, organizations, and units, the heads of the constituent units may give their opinions in writing.

The civil servant presents the report on self-assessment of the work results at the meeting, and the members attending the meeting give comments; the opinions must be recorded in the minutes and approved at the meeting.

+ Collecting comments and evaluations from the party committees of agencies, organizations, and units where the civil servants work.

+ Reviewing, deciding to evaluate, and classifying the quality of civil servants

The advisory body on personnel work of the agency competent to assess shall synthesize comments and evaluations specified at Points b and c of this Clause and related documents (if any), propose evaluation contents and quality ratings for civil servants.

Competent authorities decide to evaluate and classify the quality of civil servants.

+ The level competent to evaluate civil servants shall notify the civil servant in writing and publicly announce the results of the evaluation and quality rating; decide on the form of publicity in the agency, organization, or unit where the civil servant works, with priority given to the application of the form of publicity in the electronic environment.

- For deputies of the head and civil servants under the management of the head:

+ Civil servants self-evaluate and grade quality

Civil servants make reports on self-assessment of work results according to their assigned tasks according to Form No. 02 of the Appendix issued together with Decree 90/2020/ND-CP.

+ Comments and evaluations of civil servants

Hold a meeting at the agency, organization, or unit where the civil servant works to comment on and evaluate the civil servant.

Participants in the meeting include all civil servants of agencies, organizations, and units, or all civil servants of the unit constituting the place where the civil servant works if the agency, organization, or unit has a constituent unit.

In cases where a civil servant is a deputy of the head of an agency, organization, or unit with a constituent unit, the composition includes the collective leadership of the agency, organization, or unit, representatives of the party committee, trade unions, youth unions of the same level, and heads of constituent units; for large-scale agencies, organizations, and units, the heads of the constituent units may give their opinions in writing.

The civil servant presents the report on self-assessment of the work results at the meeting, and the members attending the meeting give comments. The opinions must be recorded in the minutes and approved at the meeting.

+ Collecting comments and evaluations from the party committees of agencies, organizations, and units where the civil servants work with respect to the head's deputy level.

+ Reviewing, deciding to evaluate, and classifying the quality of civil servants

For civil servants who are deputies of the head, heads of agencies, organizations, and units shall base themselves on comments and assessments specified at Points b and c, Clause 2, Article 18 of Decree 90/2020/ND-CP, and related documents (if any) to decide the content of assessment and quality rating for civil servants.

For civil servants under the management of the head, the head of the agency, organization, or unit shall, based on comments and evaluation meetings specified at Point b, Clause 2, Article 18 of Decree 90/2020/ND-CP, decide on the content of the assessment and quality rating for civil servants.

+ The level competent to evaluate shall notify the civil servant in writing and make a public announcement in the agency, organization, or unit where the public official works on the results of the assessment and quality classification; decide on the form of publicity in the agency, organization, or unit where the public official works.
